IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2012 -001 SA <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ACTING IN ITS <br /> CAPACITY AS THE SUCCESSOR AGENCY TO THE REDEVELOPMENT AGENCY OF <br /> THE CITY OF SAN LEANDRO APPROVING THE RECOGNIZED OBLIGATION <br /> PAYMENT SCHEDULE FOR ENFORCEABLE OBLIGATIONS OF THE <br /> FORMER REDEVELOPMENT AGENCY PURSUANT TO <br /> HEALTH AND SAFETY CODE SECTION 34177 <br /> WHEREAS, the Redevelopment Agency of the City of San Leandro ("Agency") was a <br /> redevelopment agency formed, existing and exercising its powers pursuant to California <br /> Community Redevelopment Law, Health and Safety Code Section 33000 et seq. ( "CRL "); <br /> WHEREAS, on January 9, 2012, the City Council affirmed its decision to serve as the <br /> Successor Agency to the former Agency; <br /> WHEREAS, on February 1, 2012, the Agency was dissolved pursuant to AB IX 26, and <br /> the Successor Agency is now charged with winding down operations and overseeing the <br /> dissolution process in an orderly manner; <br /> WHEREAS, staff has prepared a Recognized Obligation Payment Schedule for the period <br /> of January 1, 2012; <br /> WHEREAS, in approving the Recognized Obligation Payment Schedule, the City does not <br /> intend to waive, nor shall the City be deemed to have waived any rights the City may have <br /> pursuant to or in connection with any obligation listed on such Schedule, including without <br /> limitation, the right to modify, amend, terminate or challenge any obligation listed on such <br /> Schedule; <br /> NOW, THEREFORE, the City Council of the City of San Leandro acting in its capacity as <br /> the Successor Agency does RESOLVE as follows: <br /> 1. The Recognized Obligation Payment Schedule, attached hereto, which details the <br /> obligations of the City as it relates to the Low and Moderate Housing Fund and the Successor <br /> Agency, in order to comply with the provisions of Section 34177 of the Health and Safety Code is <br /> approved. <br /> 2. The City Manager or his designee is authorized to take all actions necessary to <br /> implement this Resolution, including without limitation, the posting of this Resolution and the <br /> Recognized Obligation Payment Schedule on the City's website, and forwarding such Schedule to <br /> the County Auditor - Controller, the State Controller, the State Department of Finance, and the <br /> Successor Agency Oversight Board. <br />
