IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2012 -025 <br /> RESOLUTION ADOPTING A NEGATIVE DECLARATION FOR ZONING CODE <br /> AMENDMENTS PERTAINING TO VARIOUS CHANGES TO THE INDUSTRIAL <br /> LIMITED, INDUSTRIAL GENERAL AND INDUSTRIAL PARK ZONING DISTRICTS AND <br /> CREATION OF INDUSTRIAL LIMITED (ASSEMBLY USE OVERLAY), INDUSTRIAL <br /> GENERAL (ASSEMBLY USE OVERLAY), AND INDUSTRIAL PARK (ASSEMBLY USE <br /> OVERLAY) ZONING USE DESIGNATION LISTS RELATED TO ASSEMBLY USES, <br /> COMMERCIAL RECREATION AND ENTERTAINMENT ACTIVITIES, <br /> AS COMPLETE AND IN COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL <br /> QUALITY ACT (CEQA) <br /> WHEREAS, the Notice of Intent to Adopt a Negative Declaration was prepared on <br /> October 28, 2011; and <br /> WHEREAS, the Notice of Intent to Adopt a Negative Declaration was circulated for a <br /> 20 -day review and comment period from October 28, 2011 to November 16, 2011. No <br /> comments were received during this period; and <br /> WHEREAS, the office of the Community Development Department of the City of San <br /> Leandro is located at 835 East 14th Street, San Leandro, California, and said Department is the <br /> custodian of the documents or other materials forming the basis for this determination; and <br /> WHEREAS, at a duly noticed public hearing held on February 21, 2012 and continued to <br /> March 19, 2012, the City Council heard public testimony and took action to adopt and pass to <br /> print an ordinance amending provisions of the San Leandro Zoning Code relating to <br /> miscellaneous changes to IL, IG, IP Zoning Districts and creation of IL (AU), IG (AU), and IP <br /> (AU) Zoning Districts related to Assembly Uses, Commercial Recreation and Entertainment <br /> Activities, and <br /> WHEREAS, said ordinance was presented to the Council for adoption and final passage <br /> at its meeting of April 2, 2012. <br /> NOW, THEREFORE, the City Council of the City of San Leandro adopts the attached <br /> Negative Declaration and finds and resolves as follows: <br /> 1. That the Negative Declaration reflects the City's judgment and analysis on the <br /> potential environmental effects of the proposed Zoning Code Amendments pertaining to <br /> Assembly Uses, Commercial Recreation and Entertainment Activities in the Industrial Districts. <br /> 2. That on the basis of the entire record, the Initial Study, and all supporting, <br /> referenced, and incorporated documents, the City Council finds that there is no substantial <br /> evidence that the proposed Zoning Code Amendments will have a significant effect on the <br />
