IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2012 -026 <br /> RESOLUTION ADOPTING A MITIGATED NEGATIVE DECLARATION FOR THE EAST <br /> 14 STREET /HESPERIAN BOULEVARD/150 AVENUE STREET IMPROVEMENTS <br /> PROJECT, PROJECT NO. 144 -39 -001, AS COMPLETE AND IN COMPLIANCE WITH THE <br /> CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) <br /> WHEREAS, on September 9, 2008, by Resolution No. 2008 -108, the City Council of the <br /> City of San Leandro approved the East 14 Street/1- iesperian Boulevard/150` Avenue Street <br /> Improvements Project ( "Project ") to improve circulation and vehicular and pedestrian safety; and <br /> WHEREAS, the Project will be constructed on the State Highway System as it will <br /> construct improvements relating to East 14 Street, which is a State Highway pursuant to <br /> California Streets and Highways Code Section 485, and falls within the jurisdiction of the State <br /> of California, Department of Transportation; and <br /> WHEREAS, the Notice of Intent to Adopt a Mitigated Negative Declaration was <br /> circulated for a 30 -day review and comment period from December 16, 2011 to January 17, <br /> 2012. No substantive comments were received during this period; and <br /> WHEREAS, the office of the Engineering and Transportation Department of the City of <br /> San Leandro is located at 835 East 14th Street, San Leandro, California, and said Department is <br /> the custodian of the documents or other materials forming the basis for this determination. <br /> NOW, THEREFORE, the City Council of the City of San Leandro adopts the attached <br /> Mitigated Negative Declaration and finds and resolves as follows: <br /> 1. The Mitigated Negative Declaration reflects the City's judgment and analysis on <br /> the potential environmental effects of the proposed East 14 Street/Hesperian Boulevard /150` <br /> Avenue Street Improvements Project. <br /> 2. On the basis of the whole record before the Council, there is no substantial <br /> evidence that the proposed East 14 Street/Hesperian Boulevard /150 Avenue Street <br /> Improvements Project will have a significant effect on the environment. <br /> *• * ** <br />
