Resolution - Council <br />File Number: 12 -060 Agenda Section: CONSENT CALENDAR <br />Agenda Number: <br />TO: City Council <br />FROM: Chris Zapata <br />City Manager <br />BY: Uchenna Udemezue <br />Engineering & Transportation Director <br />FINANCE REVIEW: James O'Leary <br />Interim Finance Director <br />TITLE: ADOPT: Resolution Rescinding a Portion of Resolution No. 2011 -117 <br />Related to Vacation of Portions of the Public Right -of -Way for Eden Road <br />(rescinds a previous Council action that vacated Eden Road due to new <br />information contained in the title report that Eden Road need not be vacated <br />as it is a private road) <br />WHEREAS, the Title Report for 3000 Davis Street does not show a public access <br />easement through the Water Pollution Control Plant (WPCP); and <br />WHEREAS, the private easement known as Eden Road bisects the WPCP property <br />through equipment and piping built during previous expansions; and <br />WHEREAS, to provide for the recordation of Parcel Map 10036 the City must rescind <br />Resolution No. 2011 -117 to void a right -of -way vacation action. <br />follows: <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />That Resolution No. 2011 -117 is hereby rescinded. <br />City of San Leandro Page 1 Printed on 411012012 <br />
