IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2012-043 <br /> RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO SIGN AND <br /> FILE, FOR AND ON BEHALF OF THE CITY OF SAN LEANDRO, A CALIFORNIA <br /> ENVIRONMENTAL PROTECTION AGENCY (CAL/EPA) GRANT APPLICATION TO <br /> IMPLEMENT ELECTRONIC REPORTING USING THE CALIFORNIA ENVIRONMENTAL <br /> REPORTING SYSTEM (CERS); AND AUTHORIZING AND DIRECTING THE <br /> CITY MANAGER TO ENTER INTO AND SIGN, FOR AND ON BEHALF OF THE <br /> CITY OF SAN LEANDRO, AN AGREEMENT WITH CAL/EPA AGREEING TO <br /> IMPLEMENT ELECTRONIC REPORTING WITH CERS <br /> WHEREAS, the City of San Leandro has been certified by the California Secretary for <br /> Environmental Protection as a Certified Unified Program Agency (the "San Leandro CUPA "); <br /> and <br /> WHEREAS, pursuant to Health and Safety Code, Chapter 6.11, section 25404(e)(1) & <br /> (2) and California Code of Regulations (CCR) Title 27, Division 1, Subdivision 4, Chapter 1, <br /> section 15185(a), CUPAs must collect and submit Unified Program information to the State; and <br /> WHEREAS, by January 1, 2013, all regulated businesses and Unified Program Agencies <br /> must submit Unified Program information electronically over the intemet using a system called <br /> the California Environmental Reporting System ( "CERS "); and <br /> WHEREAS, to assist the affected entities with the transition to electronic reporting via <br /> CERS, the California Environmental Protection Agency ( "Cal/EPA ") has established the CERS <br /> Grant Fund; and <br /> WHEREAS, the San Leandro CUPA desires to submit an application for a CERS Grant; <br /> and <br /> WHEREAS, in the event the San Leandro CUPA is awarded a CERS Grant from <br /> Cal/EPA, the City will be required to enter into a grant agreement which governs the <br /> disbursement and use of the grant funds; and <br /> WHEREAS, if the San Leandro CUPA is awarded a CERS Grant from Cal/EPA, the San <br /> Leandro CUPA shall use these grant funds in a manner consistent with the grant agreement, and <br /> any amendment thereto, to implement the requirements of the CERS electronic reporting system. <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> 1. The City Council authorizes the City Manager to submit a grant application to the <br /> California Environmental Protection Agency for a grant from the CERS Grant Fund. <br />
