• <br /> a. District Responsibilities. Except as set forth in subsection b. below, District shall, at <br /> its own cost and expense, maintain the entire school site, except the areas defined <br /> below as City maintained areas. <br /> b. City Responsibilities. Except as otherwise noted in a Supplement Agreement, City <br /> shall, at its own cost and expense, maintain the City - installed turf and landscaped <br /> areas, including mowing, fertilizing and irrigation, and such additional maintenance <br /> as set forth in any Supplemental Agreement, and City - installed improvements, such <br /> as play equipment and facilities, restrooms, etc., in the designated Open Space Site. <br /> The City Manager or designee, shall meet with the District Superintendent or <br /> designee, in order to determine an annual maintenance schedule which allows City <br /> flexible access to school sites but which does not unreasonably interfere with District <br /> use. Either party may request, in writing, that the schedule be amended to <br /> accommodate circumstances that may arise during the year. Such schedule changes <br /> may be made by mutual agreement and upon reasonable notice of five (5) working <br /> days prior to the effective date of change. <br /> In the event of an emergency and /or to abate a hazardous condition, the City or <br /> District shall have the right to initiate action to resolve said emergency and /or <br /> hazardous condition in the most effective and efficient means possible with the least <br /> disruption to City or District use. <br /> c. Water. For all sites, water will be handled as specified in a Supplemental Agreement. <br /> IX. Term of This Agreement <br /> This Agreement shall be in effect from the date of the last signature affixed hereto until <br /> June 30, 2027, except as otherwise specified in a Supplemental Agreement. In no event <br /> shall the term of a Supplemental Agreement extend past June 30, 2027, without further <br /> amending this tern. <br /> X. Supplemental Agreements and Their Terris <br /> Supplemental Agreements as referenced herein relating to specific school sites shall be <br /> executed pursuant to this Master Agreement. Such Supplemental Agreements generally <br /> shall be for the minimum period of fifteen (i5) years. <br /> X1. Termination of Agreement <br /> a. Notice of Termination. City and District niay jointly agree to terminate this Master <br /> Agreement or any of the Supplemental Agreements executed pursuant to this Master • <br /> Agreement by delivery of written notice of election to terminate at least one (1) year <br /> in advance.
