IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2012 -050 <br /> RESOLUTION AUTHORIZING THE CITY MANAGER TO NEGOTIATION THE SALE OF, <br /> AND A PURCHASE AND SALE AGREEMENT FOR, THE PROPERTY LOCATED AT 2015 <br /> LAURA AVENUE (APN 077 - 0655 - 144 -01) <br /> Recitals <br /> WHEREAS, the City of San Leandro (the "City") owns that certain real property <br /> commonly known as 2015 Laura Avenue, APN 077 - 0655- 144 -01 (the "Property "), upon which a <br /> one -story vacant building is located; and <br /> WHEREAS, the City acquired the Property in order to accommodate the widening of <br /> Davis Street for the 1 -880 HOV project and to install a park on the remainder of the parcel; and <br /> WHEREAS, the Alameda County Transportation Commission plans for the installation <br /> of a southbound HOV lane on 1 -880 and the widening of Davis Street changed, moving the <br /> roadway south to Caltrans right of way near Timothy Drive; and <br /> WHEREAS, the City has learned through community outreach that neighboring residents <br /> are not interested in a park on the Property; and <br /> WHEREAS, the City does not have a need or use for the Property, and does not wish to <br /> incur costs to maintain the Property; and <br /> WHEREAS, the City desires to sell the Property. <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> 1. The recitals above are hereby true and correct and incorporated herein. <br /> 2. The City Manager is hereby authorized and directed to negotiate the sale of the <br /> Property and the drafting of a purchase and sale agreement for such sale, subject to approval of <br /> said agreement as to form by the City Attorney, and to bring the purchase and sale agreement <br /> back to the City Council for approval. <br />
