Although there is still uncertainty with regard to direction from the California Supreme Court regarding the City of Riverside and City of Lake Forest cases, there are good reasons to prepare a prohibition ordinance until these cases are adjudicated, or the Legislature passes further laws, or other regulations are promulgated. This approach provides the City with certainty regarding Medical Marijuana regulations while keeping opportunities open for future fine tuning of regulations relative to Medical Marijuana. Staff recommends the City Council adopt the ordinance prepared, which would take effect upon the expiration of the moratorium, and would automatically sunset effective June 30, 2013.
