IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2012 -074 <br /> RESOLUTION AUTHORIZING THE ACCEPTANCE OF THE 2008 TRANSIT ORIENTED <br /> DEVELOPMENT HOUSING PROGRAM (TOD) GRANT AWARDED BY THE STATE OF <br /> CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT, AND <br /> AUTHORIZING THE EXECUTION OF A STANDARD AGREEMENT AND ALL RELATED <br /> AGREEMENTS AND DOCUMENTS REQUIRED IN CONNECTION WITH SUCH GRANT <br /> WHEREAS, the California Department of Housing and Community Development <br /> ( "HCD ") announced the availability of funding for the Transit Oriented Development (TOD) <br /> Housing Program on December 11, 2007 through a Notice of Funding Availability provided <br /> under the Housing and Emergency Shelter Trust Fund Act of 2006 (Proposition 1 C) pursuant to <br /> the TOD Implementation Program established by Part 13 of Division 31 of the Health & Safety <br /> Code, commencing with Section 53560 (the "TOD Grant Program "); <br /> WHEREAS, pursuant to authority provided by City Council Resolution No. 2008 -023, <br /> the City of San Leandro ("City ") submitted an application for funding under the TOD Grant <br /> Program to fund improvements related to a transit - oriented development in the vicinity of the <br /> San Leandro BART Station (the "Project "); <br /> WHEREAS, HCD has issued an award letter pursuant to which HCD has agreed to <br /> provide a grant in the amount of up to $10,320,000 (the "TOD Grant ") to provide partial <br /> financing for the Project; and <br /> WHEREAS, HCD requires the execution of a Standard Agreement and related <br /> documents in connection with the TOD Grant. <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> 1. The City hereby accepts the TOD Grant. <br /> 2. The City Manager, Chris Zapata, is hereby authorized to execute on behalf of the <br /> City, all agreements and documents required by HCD for participation in the TOD Grant <br /> Program, including without limitation, HCD's Standard Agreement and Disbursement <br /> Agreement, and any required amendments to such agreements and documents consistent with the <br /> intent of this Resolution. <br /> 3. The City Manager is hereby authorized to execute such other instruments and to <br /> take such other actions necessary or desirable in order to carry out the intent of this Resolution. <br /> * * * ** <br />
