IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2012 -074 RESOLUTION AUTHORIZING THE ACCEPTANCE OF THE 2008 TRANSIT ORIENTED DEVELOPMENT HOUSING PROGRAM (TOD) GRANT AWARDED BY THE STATE OF CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT, AND AUTHORIZING THE EXECUTION OF A STANDARD AGREEMENT AND ALL RELATED AGREEMENTS AND DOCUMENTS REQUIRED IN CONNECTION WITH SUCH GRANT WHEREAS, the California Department of Housing and Community Development ( "HCD ") announced the availability of funding for the Transit Oriented Development (TOD) Housing Program on December 11, 2007 through a Notice of Funding Availability provided under the Housing and Emergency Shelter Trust Fund Act of 2006 (Proposition 1 C) pursuant to the TOD Implementation Program established by Part 13 of Division 31 of the Health & Safety Code, commencing with Section 53560 (the "TOD Grant Program "); WHEREAS, pursuant to authority provided by City Council Resolution No. 2008 -023, the City of San Leandro ("City ") submitted an application for funding under the TOD Grant Program to fund improvements related to a transit - oriented development in the vicinity of the San Leandro BART Station (the "Project "); WHEREAS, HCD has issued an award letter pursuant to which HCD has agreed to provide a grant in the amount of up to $10,320,000 (the "TOD Grant ") to provide partial financing for the Project; and WHEREAS, HCD requires the execution of a Standard Agreement and related documents in connection with the TOD Grant. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: 1. The City hereby accepts the TOD Grant. 2. The City Manager, Chris Zapata, is hereby authorized to execute on behalf of the City, all agreements and documents required by HCD for participation in the TOD Grant Program, including without limitation, HCD's Standard Agreement and Disbursement Agreement, and any required amendments to such agreements and documents consistent with the intent of this Resolution. 3. The City Manager is hereby authorized to execute such other instruments and to take such other actions necessary or desirable in order to carry out the intent of this Resolution. * * * **
