City of San Leandro Entertainment Permit Ordinance <br />(San Leandro Municipal Code Chapter X -XXX) <br />Definitions. <br />For the purposes of this chapter, certain words and phrases shall be construed herein as set <br />forth in this section, unless it is apparent from the context that a different meaning is intended: <br />(A) Entertainment shall mean any of the following, except when conducted in a private <br />residence: <br />(1) Any act, play, review, pantomime, scene, or group of persons that involves a <br />dance act, or a song and dance act, performed by one or more persons, whether or not such <br />person or persons are compensated for such performance; or <br />(2) Any entertainment event that includes the playing of amplified, or acoustic music <br />by a band, or recorded music presented by a live disc jockey, group of disk jockeys, or <br />combination of live band and disk jockeys; or <br />(3) Any fashion or style show, except: <br />(a) when the same is conducted by a person as a part of a commercial business <br />which primarily involves the sale or manufacture of clothing or wearing apparel. <br />(4) "Entertainment" shall not include: <br />(a) any adult- oriented business defined in Chapter 4 -24 of this Code; or <br />(b) the activities in subsection (1), (2), and (3) when the same is conducted by a <br />Nonprofit Club or Organization as defined in subsection (F). <br />(B) Place of Entertainment shall mean every premises to which patrons or members are <br />admitted which serves food, beverages, or food and beverages, including but not limited to <br />alcoholic beverages, for consumption on the premises and wherein Entertainment as defined in <br />Subsection (A) is furnished or occurs upon the premises. <br />(C) Limited Live Performance Permit shall mean a permit allowing a Limited Live <br />Performance Locale to present Live Performances. <br />(D) Limited Live Performance Locale shall mean a locale with all the following features: <br />(1) The presentation of Live Performances is a secondary purpose of the locale <br />rather than its primary purpose. <br />(2) The locale is indoors, with an area in which Live Performances are presented that <br />is no greater than 200 square feet. <br />(3) Live Performances presented at the locale conclude by 10 p.m., except as <br />otherwise provided by the City. <br />(4) The locale is not a private residence. <br />(5) Patrons or members are admitted to the locale, which serves food, beverages, or <br />food and beverages, including but not limited to alcoholic beverages, for consumption on the <br />premises. <br />
