connection with the construction work, the construction contract or this Lease, <br /> using an occurrence policy form, with policy limits of not less than one million <br /> dollars ($1,000,000.00) per occurrence and not less than two million dollars <br /> ($2,000,000.00) in annual aggregate limits. Such insurance shall include but <br /> not be limited to: premises and operations liability, independent contractor <br /> liability, products and completed operations liability, contractual liability and <br /> personal injury liability. Landlord and Tenant shall be named as additional <br /> insureds. All general liability policies shall be endorsed with the following <br /> specific language: <br /> i. "The City of San Leandro, the Redevelopment Agency of the City of San <br /> Leandro, the San Leandro Economic Development Agency, its officers and <br /> employees, agents and volunteers are named as an additional insured for <br /> all liability arising out of the operations by or on behalf of the named <br /> insured in the performance of this agreement. <br /> ii. "The inclusion of more than one insured shall not operate to impair the <br /> rights of one insured against another insured and the coverage afforded <br /> shall apply as thought separate policies had been issued to each insured, <br /> but the inclusion of more than one insured shall not operate to increase <br /> the limits of the company's liability." <br /> iii. The insurance provided herein is primary coverage to the City of San <br /> Leandro, the Redevelopment Agency of the City of San Leandro, the San <br /> Leandro Economic Development Agency with respect to any policy of <br /> insurance or self- insurance programs maintained by the City of San <br /> Leandro, the Redevelopment Agency of the City of San Leandro, the San <br /> Leandro Economic Development Agency. No insurance held or owned by <br /> the City of San Leandro, the Redevelopment Agency of the City of San <br /> Leandro, the San Leandro Economic Development Agency shall be called <br /> upon to contribute to a loss." <br /> iv. "This policy shall not be canceled or materially changed without first <br /> giving the Redevelopment Agency of the City of San Leandro thirty (30) <br /> days' written notice by certified mail." <br /> v. "The insurer waives the right of subrogation against the City of San <br /> Leandro, the Redevelopment Agency of the City of San Leandro, the San <br /> • <br /> Leandro Economic Development Agency and against its agents and <br /> • <br /> representatives." <br /> Exhibit C Page 2 of 6 <br />
