Grantor owns that certain real property situated in the City of San Leandro, <br /> California, as more particularly described in Exhibit A attached hereto and incorporated herein <br /> (the "Property "). <br /> B. Grantor desires to provide for the establishment of a non - exclusive utility easement <br /> for the installation, maintenance, and use of a traffic signal along with any other public utility <br /> uses needed on the Property, upon the terms and conditions hereinafter set forth. <br /> NOW, THEREFORE, for good and valuable consideration, the receipt of which is hereby <br /> acknowledged, the parties agree as follows: <br /> 1. Grant of Easement. Subject to the terms and conditions hereinafter set forth, Grantor <br /> hereby grants to Grantee a non - exclusive utility easement to install, maintain, and use the area on <br /> the Property for utility purposes, as more particularly described in Exhibit A (the "Easement <br /> Area"). <br /> 2. Term. This Easement shall continue in full force and effect in perpetuity from the <br /> date of recordation of this Easement. <br /> 3. Public Utility Providers. Grantee shall have the right to make this Easement <br /> available to any public utility provider, so long as each such public utility provide: (i) is a public <br /> utility provider located within the county of the Property; (ii) provides a written request to <br /> Grantor no later than sixty (60) days prior to its requested use of the Easement Area; and (iii) <br /> files a notice in the real property records of the county in which the Property is located agreeing <br /> to be bound by the terms and conditions of this Easement. <br /> 1875305.1 <br /> 1&41979.2 <br />
