The supervisor at the next highest level of supervision shall have seven . <br /> calendar days, from receipt of the appeal, excluding Saturdays, Sundays - <br /> and holidays, in which to review and answer the grievance in writing. Although no hearing <br /> is required at this step, the employee and his/her representative may be <br /> present at, and participate in, any such hearing as the administrator may <br /> conduct. If the grievance is not resolved at this level, the employee shall <br /> have seven calendar days, excluding Saturdays, Sundays, and holidays, <br /> from receipt of the answer within which to file an appeal with the <br /> department head. <br /> �. The department head shall have seven working days from receipt of the <br /> appeal in which to review, hold hearings, and answer the grievance in <br /> writing. Unless waived by the mutual agreement of the employee or <br /> his /her representative and the department head, a hearing is required at <br /> this step and the employee and his/her representative shall have the right <br /> to be present at, and participate in, such hearing. The time limit at this <br /> step may be extended by mutual agreement between the department head <br /> and the employee or his/her representative. • • <br /> • <br /> • <br /> The Union may in its own name file a grievance alleging that the <br /> County/Department has failed to provide it some organizational right which <br /> is established by written Department rules or by this Memorandum of <br /> Understanding, provided that such right is not made subject to the <br /> discretion provided that such right is not made subject to the discretion of <br /> the Chief or County/District. Such Union grievances shall be filed with the <br /> department head on the form designated by the County and heard and <br /> determined pursuant to the provisions of the fifth step of the grievance <br /> procedure. <br /> E. WAIVER OF APPEAL STEPS.
