• • <br /> SIDELETTER OF AGREEMENT <br /> INTERNATIONAL ASSOCIATION OF FIREFIGHTERS LOCAL 1428 <br /> May 16, 1993 <br /> SICKOUT SIDELETTER <br /> SUMMARY: Include a "Sickout Sideletter" in the new Memorandum of Understanding, as follows: <br /> SICKOUT: The Fire Department and Union agree as follows: <br /> 1. The Fire Department and Union have meet and conferred pursuant to Government Code Section <br /> 3500 et Seq. regarding the Fire Department's policy of denying sick leave with pay to employees <br /> who have engaged in a "sickout" as a form of concerted action during a dispute. <br /> 2. The Fire Department and Union agree that an employee absent during what the Fire Chief, in <br /> his/her discretion, determines to be a concerted Sickout shall not be eligible for sick leave with <br /> pay for such absence unless the employee submits within five (5) days from the date of such <br /> absence evidence of sickness or injury consisting of declarations of the employee and a physician <br /> signed on forms supplied by the Fire Department, copies of which are attached. The Fire Chief, <br /> may waive the declarations requirement where there is compelling evidence of the employee's <br /> sickness or injury. <br /> 3. Any dispute as to whether the Fire Chief has erred in determining that a concerted sickout has <br /> occurred may be promptly appealed by the Union to the Alameda County Director of Personnel <br /> and Labor Relations. <br /> FOR THE FiRE DEPARTMENT FOR THE UNION <br /> • <br /> Date: Date: <br /> 216 <br /> FIRE - 50 <br />
