City of San Leandro <br />Meeting Date: January 7, 2013 <br />Resolution - SA <br />Agenda Section:File Number:12-597 CONSENT CALENDAR <br />Agenda Number: <br />TO:City Council <br />FROM:Chris Zapata <br />City Manager <br />BY:Cynthia Battenberg <br />Business Development Manager <br />FINANCE REVIEW:Not Applicable <br />TITLE:ADOPT: Resolution of the Successor Agency to the Redevelopment Agency <br />of the City of San Leandro Authorizing the Acceptance of Quitclaim Deeds for <br />Properties Previously Transferred by the Former Redevelopment Agency of <br />the City of San Leandro to the City of San Leandro (authorizes Successor <br />Agency acceptance of the transfer of non-public property assets as required <br />by law) <br />WHEREAS, the Redevelopment Agency of the City of San Leandro (the “Agency”) <br />previously approved an action transferring certain real assets pursuant to disposition and <br />development agreements and assignment agreements from the City of San Leandro (the <br />“City”) on March 3, 2011 by Agency Resolution No . 2011-004 RDA and City Council <br />Resolution No. 2011-058; and <br />WHEREAS, on June 28, 2011, the California Legislature adopted, the Governor <br />signed, and in December 29, 2011 the California Supreme Court in California Redevelopment <br />Association, et al. v. Ana Matosantos, et al., upheld ABx1 26 (“AB 26”), legislation that <br />amends the California Redevelopment Law and provides that the Redevelopment Agency be <br />dissolved effective as of February 1, 2012; and <br />WHEREAS, under AB 26, the Redevelopment Agency was replaced with the <br />Successor Agency to the Redevelopment Agency of the City of San Leandro (the “Successor <br />Agency”) effective February 1, 2012; and <br />WHEREAS, among other things, AB 26 voids certain transactions between the <br />Redevelopment Agency and the City that occurred after January 1, 2011; and <br />WHEREAS, the City now desires to transfer the following non-public assets <br />(collectively, the “Assets”) from the City back to the Successor Agency : <br />Address APN <br />Page 1 City of San Leandro Printed on 1/2/2013
