99315159 <br /> any Article or Section herein and any table of contents or index attached to this <br /> Agreement or any copy thereof are solely for convenience of reference and shall not <br /> constitute part of this Agreement or affect its meaning, construction, or effect. <br /> SECTION 3. TERM OF AGREEMENT <br /> The terms of this Agreement shall be for 30 years from execution of the Loan <br /> Agreement. At the end of this term, City shall discharge all obligations of Recipient. <br /> SECTION 4. USE OF PROPERTY <br /> Project shall be used as a safe house within the City of San Leandro for <br /> battered women and their children. The Recipient shall institute and enforce a strict <br /> confidentiality program that includes: requiring all residents and program staff to sign <br /> confidentiality agreements regarding the location; maintaining unpublished phone <br /> numbers and addresses; prohibiting mail delivery at the location; and limiting or <br /> prohibiting visits from family and friends of the residents. The Project shall meet the <br /> density restrictions of the State Housing Code. The house shall be staffed 24 hours a <br /> day. Any modifications to the staffing schedule must be approved by the <br /> Development Services Director. Staff members and residents shall use on-site parking <br /> first, before using on-street parking. <br /> SECTION S. RENT LEVELS <br /> Rent levels shall be established that are affordable. Rent increases are subject <br /> to the terms and conditions of the United States Housing Act of 1937 and 24 CFR <br /> 813.106. Under these authorities, each resident may pay as rent, no more than the <br /> higher of: <br /> a. 30 percent of the family's monthly adjusted income (adjustment factors <br /> include the age of the individual, medical expenses, size of family and child care <br /> expenses as described in detail in 24 CFR 813.102). <br /> b. 10 percent of the family's monthly gross income; or <br /> c. If the family is receiving payments for welfare assistance from a public <br /> agency and a part of the payments, adjusted in accordance with the family's actual <br /> housing costs, is specifically designated by the agency to meet the family's housing <br /> costs, the portion of the payments that is designated. <br /> 2 <br />
