• <br /> N. Any noise or sounds from the activities inside the building shall not be detectable from <br /> beyond the property lines. <br /> O. There shall be no loitering permitted outside the building. "NO LOITERING" signs shall <br /> be posted outside the building, with location and details subject to the approval of the <br /> Community Development Director. <br /> P. This Conditional Use Permit shall be subject to review by the City within six-months of <br /> its approval to determine if noise,parking,traffic, events with alcoholic beverages, or any <br /> other impacts are affecting the adjacent persons or properties. <br /> Q. In the event there is a demonstrable violation of a condition in this Use Permit, the <br /> Zoning Enforcement Official may proceed with enforcement per Zoning Code Section 5- <br /> 2906. <br /> R. A condition for the annual renewal of the Business License for assembly use shall be the <br /> inspection and clearance from the City Building and Safety Services Division. The <br /> inspection shall be conducted to verify that the conditions listed in this document are <br /> being maintained. <br /> S. Certified security company personnel shall be provided for the live performances. Within <br /> 30 days of approval of the Conditional Use Permit application,the applicant shall provide <br /> a final security plan for the Police Department for review and approval. Said certified <br /> security company shall obtain the required City Business License and any other necessary <br /> documentation. <br /> II. GENERAL REQUIREMENTS <br /> A. The approvals granted by the City as a result of this application, as well as the Conditions of <br /> Approval, shall be recorded in the office of the County Recorder of Alameda County prior <br /> to issuance of building permits. <br /> B. No application for amendment of the application or Conditions of Approval may be <br /> submitted or accepted for processing by the City unless (i) there is full compliance with all <br /> terms of the application and Conditions of Approval; or (ii) the Community Development <br /> Director waives compliance with the terms of the application and Conditions of Approval <br /> pending application for amendment. <br /> C. Pursuant to Zoning Code Section 5-2218,this approval shall lapse on July 7,2012,unless a) <br /> a business license has been issued, coupled with diligent progress evidencing a good-faith <br /> intent to commence the intended use, or b) a written request for a one-year extension of the <br /> use permit is approved by the Zoning Enforcement Official. <br /> Agreement to Conditions PLN2011-00011 <br /> July 7,2011 Page 5 of 5 <br />
