Legal Services Analysis and Report City of San Leandro <br />February 2013 Municipal Resource Group <br /> <br /> <br /> 28 <br />In‐House City Attorney <br />Advantages: <br /> City Attorney Office and staff have office space and are on‐site. <br /> Attorneys may be available to participate in early “drop‐in” discussions regarding <br />matters that may later become legal matters. <br /> The City Attorney can be an active member of the executive team. <br /> City selects all attorneys and support staff. <br /> The City Attorney Office may be able to coordinate daily with risk management if <br />the risk management function reports directly to the City Attorney Office. <br /> City Attorney costs are controlled by budgeted staff levels. <br /> The City Attorney is accountable to the City/ City Council only. <br />Disadvantages: <br /> Expertise may be limited based on the candidate recruitment pool and the <br />experience of the incumbent staff members. <br /> Personnel costs, including vacations and leaves, are incurred regardless of <br />workload. <br /> Attorney training may be limited by available City resources and the ability of <br />attorneys to be away from the office. <br /> Limitations on volume of work that can be handled at any one time. <br /> If a key attorney is absent (vacations / leaves), it may be difficult to access services <br />on a timely basis. <br /> The City must address in‐house City Attorney Office personnel matters. <br /> The City will incur legacy costs such as OPEB. <br /> The City must provide adequate office space, confidential file storage and <br />conference room access to support the City Attorney’s Office operations.
