Trustor owns fee simple title to the land described in Exhibit A attached hereto and <br /> incorporated herein by this reference (the"Land"). <br /> B. Beneficiary and Trustor have entered into that certain Capital Improvement Loan <br /> Agreement dated as of July 1, 2008 and amended by that certain Addendum I executed on September 27, <br /> 2010, that certain Addendum II executed on September 25, 2012, and that certain Addendum III executed <br /> on December 4, 2012, (collectively, the"Loan Agreement"), pursuant to which Beneficiary is providing a <br /> loan to Trustor in the amount of One Hundred Thousand Dollars and No Cents($100,000.00) (the"Loan") <br /> for the purpose of assisting Trustor with capital improvement projects. The Loan is funded with Community <br /> Development Block Grant("CDBG") funds granted to Beneficiary. Trustor has issued to Beneficiary that <br /> certain Capital Improvement Promissory Note, as amended by that certain First Amendment to Capital <br /> Improvement Promissory Note ("First Amendment to Note") dated as of the date hereof(collectively, the <br /> "Note"), to evidence Trustor's obligation to repay the Loan. . <br /> C. As a condition of increasing the amount of the Loan as set forth in the First Amendment to <br /> Note, Beneficiary has required that Trustor enter into this Deed of Trust and grant to Trustee for the benefit <br /> of Beneficiary, a lien and security interest in the Property (defined below) to secure repayment of the Note <br /> and performance of Trustor's obligations under the Loan Agreement and the Loan Documents (defined <br /> below). <br /> NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of which are <br /> hereby acknowledged, it is agreed as follows. <br /> II <br /> 2002455.2 1 <br />
