City of San Leandro <br />Notes to Basic Financial Statements <br />For the year ended June 30, 2012 <br /> <br /> <br />90 <br /> <br />NOTE 18 – REDEVELOPMENT AGENCY DISSOLUTION AND SUCCESSOR AGENCY <br />ACTIVITIES, Continued <br /> <br />A. Redevelopment Suspension, continued <br /> <br />The suspension provisions of ABx1 26 prohibit all redevelopment agencies from a wide range of activities, <br />including incurring new indebtedness or obligations, entering into or modifying agreements or contracts, acquiring <br />or disposing of real property, taking actions to adopt or amend redevelopment plans and other similar actions, except <br />actions required by law or to carry out existing enforceable obligations, as defined in ABx1 26. During the <br />suspension period, an agency was required to prepare an Enforceable Obligation Payment Schedule no later than <br />August 29, 2011, that allowed it to continue to pay existing obligations. The Agency adopted its Enforceable <br />Obligation Payment Schedule on August 23, 2011. <br /> <br />In addition, ABx1 26 directed the State Controller to review the activities of all redevelopment agencies to <br />determine whether an asset transfer between an agency and any public agency occurred on or after January 1, 2011. <br />If an asset transfer did occur and the public agency that received the asset is not contractually committed to a third <br />party for the expenditure or encumbrance of the asset, the legislation purports to require the State Controller to order <br />the asset returned to the redevelopment agency. The State Controller’s Office has scheduled, but not yet <br />completed its asset transfer review. <br /> <br />Effective January 31, 2012, the Redevelopment Agency was dissolved. Certain assets of the Redevelopment <br />Agency Low and Moderate Income Housing Fund were distributed to a Housing Successor; and all remaining <br />Redevelopment Agency assets and liabilities were distributed to a Successor Agency. <br /> <br />The City elected to become the Housing Successor and on February 1, 2012, certain housing assets were transferred <br />to the City’s Affordable Housing Successor Special Revenue Fund. <br /> <br />B. Redevelopment Dissolution <br /> <br />The City also elected to become the Successor Agency and on February 1, 2012 the Redevelopment Agency’s <br />remaining assets were distributed to and liabilities were assumed by the Successor Agency. ABx1 26 requires the <br />establishment of an Oversight Board to oversee the activities of the Successor Agency and one was established on <br />April 30, 2012. The activities of the Successor Agency are subject to review and approval of the Oversight Board, <br />which is comprised of seven members, including one member of City Council and one former Redevelopment <br />Agency employee appointed by the Mayor. <br /> <br />The activities of the Housing Successor are reported in the Affordable Housing Assets Special Revenue Fund as <br />the City has control of those assets, which may be used in accordance with the low and moderate income housing <br />provisions of California Redevelopment Law. <br /> <br />On February 1, 2012 the Redevelopment Agency’s remaining net assets were distributed to the Successor Agency. <br />ABx1 26 requires the establishment of an Oversight Board to oversee the activities of the Successor Agency and one <br />was established on April 6, 2012.
