WHEREAS, the Board of Zoning Adjustments reviewed the staff report, <br />the revised Mitigated Negative Declaration, including comments and responses, <br />at a noticed public hearing on February 7, 2013 at which time all interested <br />parties had the opportunity to be heard; and <br />NOW, THEREFORE, BE IT RESOLVED THAT: <br />A. The foregoing recitals are true and correct and made a part of this resolution. <br />B. The Board of Zoning Adjustments reviewed and considered the revised <br />Mitigated Negative Declaration, including comments received during the public <br />review period and the City's written responses to comments, prior to acting on <br />the Project. <br />C. Based on the whole of the record, the Board of Zoning Adjustments hereby <br />approves the height variance to allow a wind turbine structure with a maximum <br />height of 100 feet, based on the variance findings in attached Exhibit B and <br />subject to the conditions of approval in attached Exhibit C, both of which exhibits <br />are incorporated herein by reference. <br />PASSED, APPROVED, AND ADOPTED this 7th day of February, 2013 by the <br />following vote: <br />AYES: Members Daly, Thomas, Vice Chair Mendieta, Chair Houston (4) <br />NOES: None (0) <br />ABSENT: Members Abelee, Makin, Palma (3) <br />ABSTAIN: None (0) <br />Catherine Vierra Houston, Chairperson <br />Sally Barros, Secretary <br />2
