City of San Leandro <br />Meeting Date: June 3, 2013 <br />Resolution - Council <br />Agenda Section:File Number:13-256 CONSENT CALENDAR <br />Agenda Number: <br />TO:City Council <br />FROM:Chris Zapata <br />City Manager <br />BY:Uchenna Udemezue <br />Engineering & Transportation Director <br />FINANCE REVIEW:David Baum <br />Finance Director <br />TITLE:ADOPT: Resolution Authorizing the City Manager to Execute an Agreement <br />with the San Leandro Unified School District to Allow the Construction of and <br />to Jointly Maintain a Walking Path at McCartney Park (allows the School <br />District to construct, operate and share in the cost to maintain a continuous <br />pathway from Washington Elementary School through McCartney Park ) <br />WHEREAS, Section 10900 et seq. of the California Education Code (the Community <br />Recreation Act) authorizes cities and school districts to organize, promote and conduct <br />programs or community recreation for the promotion and attainment of general educational <br />and recreational objectives, and to construct, maintain and operate recreation centers, <br />including outdoor playing fields; and <br />WHEREAS, it is the policy of the City and the San Leandro Unified School District <br />(“the District”) to jointly undertake the development, installation, construction and <br />maintenance of recreational facilities to reduce capital and operational costs to both <br />governmental agencies; and <br />WHEREAS, the City and the District entered into an agreement dated March 21, 1960, <br />for the construction and operation of McCartney Park, with amendments that included <br />maintenance responsibilities. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />That the City Manager is authorized to execute an agreement, subject to approval as to <br />form by the City Attorney, with the San Leandro Unified School District giving the District the <br />right to construct a walking path on City land at McCartney Park located adjacent to <br />Washington Elementary School for school use during school hours and public use after school <br />hours or when school is not in session. <br />Page 1 City of San Leandro Printed on 5/29/2013
