From Section 4(a): “(Determine) the proportionate special benefit derived by each parcel in <br />relationshiptotheentiretyofthe..........costofpublicimprovement(s)orthemaintenanceandoperation <br />expenses...........orthecostofthepropertyrelatedservicebeingprovided. <br />Eachidentifiedparcelwithinthedistrictwillbeassessedbasedonpropertyanddevelopmentcharacteristicsunique <br />onlytothatparcel.Thecalculatedassessmentratesareappliedtotheactualmeasuredparametersofeachparceland <br />therebyareproportionaltoeachandeveryotheridentifiedparcelwithinthedistrict.Largerparcelsandbuildings and <br />thoselocatedinZone1 areexpectedtoimpactthedemandforservicesandprogramstoagreaterextentthansmaller <br />ones andthosewithinZone2 andthusareassignedahigherproportionatedegreeofassessmentprogramandservice <br />costs.Theproportionalityisfurtherachievedbysettingtargetedformulacomponentweightsfortherespectiveparcel <br />byparcelidentifiedlandand buildingattributes. <br />Theproportionatespecialbenefitcostforeachparcelhasbeencalculatedbasedonoptimumproportionateformula <br />componentsandareeachlistedonAttachment1tothisReport.Theindividualpercentages(i.e.proportionate <br />relationshiptothetotalspecialbenefitrelatedprogramandactivitycosts)iscomputedbydividingtheindividual <br />parcelassessmentbythetotalspecialbenefitprogramcosts. <br />Finding4. From Section 4(a): “No assessment shall be imposed on any parcel which exceedsthereasonable <br />cost of the proportional special benefit conferred on that parcel.” <br />Notonlyaretheproposedprogramcostsreasonableduetothebenefitofgrouppurchasingandcontractingwhich <br />wouldbepossiblethroughtheDowntownSanLeandroCBD,theyarealsoconsiderablylessthanotheroptions <br />consideredbytheDowntownSanLeandroCBDproponentgroup.Theactualassessmentrateforeachparcelwithin <br />theCBDdirectlyrelatetothelevelofservicetobeprovidedbasedontherespectiveamountof streetfrontage, <br />buildingarea,parcelsizeand location ofeachparcel.Forresidentialcondominiums,theassessmentraterelatestothe <br />buildingpadareaofeachunit. <br />Finding5. From Section 4(a): “Parcels........that are owned or used by any (public) agency shall not be exempt <br />from assessment..........” <br />AnypubliclyownedparcelswithintheCBDwouldalsoreceivebenefitscommensuratewiththeassessmentspaid <br />intotheDowntownSanLeandroCBD.Thereisnocompellingevidencethatpubliclyownedparcelsdonotbenefit <br />equallytoprivatelyownedparcelsand,thus,wouldbeassessedin thesamemannerandratesasprivateparcelsinthe <br />CBD.Thepublicallyownedparcelsareshowinthechartbelow:
