RECORDING FEE: 0.00 <br /> Marian Handa, City Clerk <br /> City of San Leandro 9 PGS <br /> 835 East 14th Street <br /> San Leandro, California 94577 THIS SPACE FOR RECORDER'S USE ONLY <br /> (No fee pursuant to Government Code Section27383) <br /> AGREEMENT TO CONDITIONS <br /> PLN2012-00033-2013 Farallon Drive <br /> The Rosalinde & Arthur Gilbert Foundation (property owner) <br /> THIS AGREEMENT is entered into by and between the CITY OF SAN LEANDRO, a municipal <br /> corporation, hereinafter referred to as "City," and The Rosalinde & Arthur Gilbert Foundation, <br /> hereinafter referred to as"property owner". <br /> Property Owner applied for and received Site Plan Review approval of PLN2012-00033, approved <br /> on November 28, 2012, for four (4) new dock doors as a result of re-converting four (4) existing <br /> store-front window spaces back to their original dock-door use along with seven (7) other still- <br /> remaining dock doors on the west side of the building and visible from the public street, at 2013 <br /> Farallon Drive, Alameda County Assessor's Parcel Number 77B-851-59. Any and all previous <br /> approvals related to this subject property shall remain in effect except as hereinafter modified within <br /> this agreement and associated conditions of approval. <br /> NOW, THEREFORE, pursuant to the applicable provisions of the Zoning Code, it is <br /> mutually agreed as follows: <br /> 1. Property Owner agrees to comply with the Conditions of Approval adopted by the City <br /> of San Leandro Zoning Enforcement Official, more specifically described in the list of Conditions <br /> of Approval, attached hereto, and as described in the exhibits on file in the Community <br /> Development Department, all of which are incorporated herein by this reference. <br /> 2. This agreement shall be binding upon and inure to the benefit of the parties hereto and <br /> their respective heirs, successors, and assigns. <br /> 3. City is authorized to record this agreement and any amendments thereto with the <br /> Alameda County Recorder, California. All amendments hereto must be in writing and signed by the <br /> appropriate authorities of the City and Property Owner. The Property Owner will be charged the <br /> costs of recordation and agrees to pay same.
