The applicant shall comply with Exhibits A through D, attached to the staff report dated March 7, 2013, except as hereinafter modified. (Exhibits are on file at the City of San Leandro Community Development Department, 835 East 14th Street, San Leandro, California). Exhibit A — Project Notes, Vicinity Map and Site Plan Exhibit B — Site Plan Exhibit C— Elevations and Floor Plan of Proposed Rear Garage and Office Exhibit D — Streetscape and Sections for Proposed Rear Garage and Office B. The applicant and/or property owner shall be responsible for assuring that any successor in interest who assumes responsibility for this zoning approval is informed of its terms and conditions. C. Construction shall commence within one (1) year following Board of Zoning Adjustments approval and shall be substantially completed one year after commencement of construction. For the purpose of compliance with this condition, commencement of construction shall be defined as the pouring or construction of a substantial portion of the building foundation structures. Pursuant to Zoning Code Section 5-2218, this approval shall lapse on March 7, 2014 unless a) a building permit has been issued, coupled with diligent progress evidencing good faith intent to commence the intended use, or b) a written request for a one-year extension of the use permit is approved by the Zoning Enforcement Official. 11. USE RESTRICTIONS A. This Conditional Use Permit, Site Plan Review, and Fence Modification approves construction of a detached 1,351 square-foot two-story accessory structure consisting of a garage and an office to the rear of the existing 1,834 square-foot home and a four-foot . fence set back five feet from the front property line along the frontage and twenty feet across the driveway at 568 Warwick Avenue. Said parcel is also known as Alameda County Assessor's Parcel Numbers 76-288-31; E. and M. Davis, Jr. (applicants and property owners). B. Any changes to the approved exterior design of the accessory structure shall be submitted in writing as a request to the Community Development Director. The request shall include but is not limited to the reason(s) for the change(s) to the exterior design and exhibits that shall be neat, accurate, to scale, including dimensions, colors materials and finishes. C. Within thirty(30) days of issuance of a building permit for this approved project, the applicant shall record with the Alameda County Recorder a Notice of Occupancy Restriction that states that Owner agrees that the existing residence and the described new accessory structure together shall not be used as more than one residential unit with one kitchen at any time; Agreement to Conditions March 7,2013 • PLN2012-00034 Page 3 of 7
