• <br /> CONDITIONS OF APPROVAL <br /> PLN2012-00034 <br /> 568 Warwick Avenue <br /> Alameda County Assessor's Parcel Number 76-288-3.1 <br /> E. and M. Davis, Jr(applicants and property owners) <br /> COMPLIANCE WITH APPROVED PLANS <br /> A. The applicant shall comply with Exhibits A through D, attached to the staff report dated <br /> March 7, 2013, except as hereinafter modified. (Exhibits are on file at the City of San Leandro <br /> Community Development Department, 835 East 14th Street, San Leandro, California). <br /> Exhibit A — Project Notes, Vicinity Map and Site Plan <br /> Exhibit B — Site Plan <br /> Exhibit C— Elevations and Floor Plan of Proposed Rear Garage and Office <br /> Exhibit D — Streetscape and Sections for Proposed Rear Garage and Office <br /> B. The applicant and/or property owner shall be responsible for assuring that any successor in <br /> interest who assumes responsibility for this zoning approval is informed of its terms and <br /> conditions. <br /> C. Construction shall commence within one (1) year following Board of Zoning Adjustments <br /> approval and shall be substantially completed one year after commencement of <br /> construction. For the purpose of compliance with this condition, commencement of <br /> construction shall be defined as the pouring or construction of a substantial portion of the <br /> building foundation structures. Pursuant to Zoning Code Section 5-2218, this approval shall <br /> lapse on March 7, 2014 unless a) a building permit has been issued, coupled with diligent <br /> progress evidencing good faith intent to commence the intended use, or b) a written request <br /> for a one-year extension of the use permit is approved by the Zoning Enforcement Official. <br /> 11. USE RESTRICTIONS <br /> A. This Conditional Use Permit, Site Plan Review, and Fence Modification approves <br /> construction of a detached 1,351 square-foot two-story accessory structure consisting of a <br /> garage and an office to the rear of the existing 1,834 square-foot home and a four-foot . <br /> fence set back five feet from the front property line along the frontage and twenty feet <br /> across the driveway at 568 Warwick Avenue. Said parcel is also known as Alameda County <br /> Assessor's Parcel Numbers 76-288-31; E. and M. Davis, Jr. (applicants and property owners). <br /> B. Any changes to the approved exterior design of the accessory structure shall be submitted in <br /> writing as a request to the Community Development Director. The request shall include but is <br /> not limited to the reason(s) for the change(s) to the exterior design and exhibits that shall be <br /> neat, accurate, to scale, including dimensions, colors materials and finishes. <br /> C. Within thirty(30) days of issuance of a building permit for this approved project, the applicant <br /> shall record with the Alameda County Recorder a Notice of Occupancy Restriction that states <br /> that Owner agrees that the existing residence and the described new accessory structure <br /> together shall not be used as more than one residential unit with one kitchen at any time; <br /> Agreement to Conditions March 7,2013 • <br /> PLN2012-00034 Page 3 of 7 <br />
