City of San Leandro <br />Meeting Date: November 4, 2013 <br />Ordinance <br />Agenda Section:File Number:13-546 ACTION ITEMS <br />Agenda Number: <br />TO:City Council <br />FROM:Chris Zapata <br />City Manager <br />BY:Rich Pio Roda <br />City Attorney <br />FINANCE REVIEW:Not Applicable <br />TITLE:ORDINANCE Adding Chapter 4-33 to Title 4 of the San Leandro Municipal <br />Code Pertaining to Medical Cannabis Dispensary Permits (provides for <br />establishment of up to two medical marijuana dispensaries in the City and <br />regulates their operations) <br />The City of San Leandro City Council does hereby ORDAIN as follows: <br />SECTION 1.AMENDMENT OF CODE. San Leandro Municipal Code Title 4 is hereby <br />amended to add Chapter 4-33, as set forth in Attachment incorporated into this ordinance by <br />this reference. <br />SECTION 2.SEVERABILITY. This Chapter shall be enforced to the full extent of the <br />authority of the City. If any section, subsection, paragraph, sentence or word of this chapter is <br />deemed to be invalid or beyond the authority of the City, either on its face or as applied, the <br />invalidity of such provision shall not affect the other sections , subsections, paragraphs, <br />sentences, or words of this chapter, and the applications thereof; and to that end the sections, <br />subsections, paragraphs, sentences and words of this chapter shall be deemed severable. <br />SECTION 3.EFFECTIVE DATE AND PUBLICATION. This ordinance shall take effect <br />upon the certification of a City ballot measure that approves the taxation of the gross receipts <br />generated by the operations of any Dispensary operating within the City. The City Clerk is <br />directed to publish the title once and post a complete copy thereof on the City Council <br />Chamber bulletin board for five (5) days prior to adoption. <br />1964161.4 <br />Page 1 City of San Leandro Printed on 10/30/2013
