City of San Leandro <br />Meeting Date: November 18, 2013 <br />Ordinance <br />Agenda Section:File Number:13-492 PUBLIC HEARINGS – CITY <br />COUNCIL <br />Agenda Number: <br />TO:City Council <br />FROM:Chris Zapata <br />City Manager <br />BY:Cynthia Battenberg <br />Community Development Director <br />FINANCE REVIEW:Not Applicable <br />TITLE:ORDINANCE Repealing Article 6 of Chapter 3 of Title I and Article 1 of <br />Chapter 5 of Title VII and Adding a new Article 1 to Chapter 5 of Title VII of the <br />San Leandro Municipal Code, Amending the State-Mandated California <br />Building Standards Code, and Adopting by Reference the International <br />Building Code, as Amended (adopts relevant codes by reference with minor <br />structural amendments relating to updating seismic design criteria based on <br />City’s proximity to earthquake faults and corrections to the model code <br />structural design standards) <br />The City Council of the City of San Leandro does ORDAIN as follows: <br />Section 1.Article 6 of Chapter 3 of Title I of the San Leandro Municipal Code is hereby <br />repealed. <br />Section 2. Article 1 of Chapter 5 of Title VII of the San Leandro Municipal Code is <br />hereby repealed. <br />Section 3.A new Article 1 is hereby added to Chapter 5 of Title VII of the San Leandro <br />Municipal Code as set forth in Attachment A , attached hereto and incorporated into this <br />ordinance by this reference. <br />.Section 4. Severability. If any section, subsection, subdivision, paragraph, <br />sentence, clause or phrase of the Ordinance is for any reason held to be unconstitutional, <br />invalid, or ineffective by any court of competent jurisdiction , such decision shall not affect the <br />validity or effectiveness of the remaining portions of this Ordinance or any part hereof . The <br />City Council hereby declares that it would have passed each section, subsection, subdivision, <br />paragraph, sentence, clause, phrase of the Ordinance irrespective of the fact that one or more <br />of them would be declared unconstitutional or invalid.
