City of San Leandro <br />Meeting Date: November 18, 2013 <br />Ordinance <br />Agenda Section:File Number:13-501 PUBLIC HEARINGS – CITY <br />COUNCIL <br />Agenda Number: <br />TO:City Council <br />FROM:Chris Zapata <br />City Manager <br />BY:Cynthia Battenberg <br />Community Development Director <br />FINANCE REVIEW:Not Applicable <br />TITLE:ORDINANCE Repealing Article 1 and Adding Article 1 to Chapter 3 of Title III <br />of the San Leandro Municipal Code, Amending the State-Mandated California <br />Building Standards Code, and Adopting by Reference the International Fire <br />Code, as Amended (adopts relevant codes by reference with minor structural <br />amendments relating to updating seismic design criteria based on City’s <br />proximity to earthquake faults and corrections to the model code structural <br />design standards) <br />The City Council of the City of San Leandro does ORDAIN as follows: <br />Section 1.Article 1 of Chapter 3 of Title III of the San Leandro Municipal Code is hereby <br />repealed. <br />Section 2.Article 1 is hereby added to Chapter 3 of Title III of the San Leandro <br />Municipal Code as set forth in Attachment A , attached hereto and incorporated into this <br />ordinance by this reference. <br />Section 3.Severability. If any section, subsection, subdivision, paragraph, sentence, <br />clause or phrase of the Ordinance is for any reason held to be unconstitutional, invalid, or <br />ineffective by any court of competent jurisdiction , such decision shall not affect the validity or <br />effectiveness of the remaining portions of this Ordinance or any part hereof . The City Council <br />hereby declares that it would have passed each section, subsection, subdivision, paragraph, <br />sentence, clause phrase of the Ordinance irrespective of the fact that one or more of them <br />would be declared unconstitutional or invalid. To this end, the provisions of the Ordinance are <br />declared to be severable. <br />Section 4.Effective Date and Publication . This ordinance shall take effect on January <br />1, 2014, and the title thereof shall be published twice prior to adoption pursuant to California <br />Government Code Section 50022.3. The City Clerk is directed to post a complete copy of this <br />ordinance on the City Council Chamber bulletin board prior to its adoption. <br />Page 1 City of San Leandro Printed on 11/12/2013
