SAN LEANDRO ADMINISTRATIVE CODE TITLE 5 COMMUNITY DEVELOPMENT <br /> Chapter 4 Development Agreements <br /> §5.4.100: AUTHORITY. <br /> These regulations are adopted under the authority of California Government Code Sections 65864- <br /> 65869.5. <br /> X5.4.105: DEFINITIONS. <br /> (a) Development Agreement. "Development agreement" means a development agreement en- <br /> tered into between the City and a Developer (as defined in §5.4.115) pursuant to California <br /> Government Code Section 65864 et seq. and this Chapter. <br /> (b) Person. "Person" means an individual, group, partnership, firm, association, corporation, <br /> trust, governmental agency, or any other form of business or legal entity. <br /> (c) Project. "Project" means the development project that is the subject of a development <br /> agreement. <br /> §5.4.110: FORMS, INFORMATION,AND FEES. <br /> (a) Any person wishing to enter into a development agreement with the City shall file a devel- <br /> opment agreement application with the Community Development Director("Director"). <br /> (b) The Director shall prescribe the form for each application, notice and documents provided <br /> for or required hereunder for the preparation and implementation of development agree- <br /> ments. <br /> (c) The Director may require an applicant to submit such information and supporting data as <br /> considered necessary to process the application. <br /> (d) Each application shall be accompanied by a proposed development agreement which shall <br /> be on the City's form for development agreements. <br /> (e) The City Council shall establish by resolution the schedule of fees and charges for the filing <br /> and processing of applications and documents provided for or required hereunder. <br /> &5.4.115: QUALIFICATION AS AN APPLICANT. <br /> Only a qualified applicant may file an application to enter into a development agreement. A quali- <br /> fied applicant is a person, including any authorized agent, who has a legal or equitable interest in <br /> the real property which is the subject of the development agreement, provided that in all instances <br /> the owner(s) of fee title of the real property shall join in the application or the development agree- <br /> ment shall be conditional upon the close of escrow vesting fee title to the property in the Developer. <br /> The Director may require an applicant to submit proof of interest in the real property and of the au- <br /> thority of any agent to act for the applicant.
