SAN LEANDRO ADMINISTRATIVE CODE TITLE 5 COMMUNITY DEVELOPMENT Chapter 4 Development Agreements §5.4.100: AUTHORITY. These regulations are adopted under the authority of California Government Code Sections 65864- 65869.5. X5.4.105: DEFINITIONS. (a) Development Agreement. "Development agreement" means a development agreement en- tered into between the City and a Developer (as defined in §5.4.115) pursuant to California Government Code Section 65864 et seq. and this Chapter. (b) Person. "Person" means an individual, group, partnership, firm, association, corporation, trust, governmental agency, or any other form of business or legal entity. (c) Project. "Project" means the development project that is the subject of a development agreement. §5.4.110: FORMS, INFORMATION,AND FEES. (a) Any person wishing to enter into a development agreement with the City shall file a devel- opment agreement application with the Community Development Director("Director"). (b) The Director shall prescribe the form for each application, notice and documents provided for or required hereunder for the preparation and implementation of development agree- ments. (c) The Director may require an applicant to submit such information and supporting data as considered necessary to process the application. (d) Each application shall be accompanied by a proposed development agreement which shall be on the City's form for development agreements. (e) The City Council shall establish by resolution the schedule of fees and charges for the filing and processing of applications and documents provided for or required hereunder. &5.4.115: QUALIFICATION AS AN APPLICANT. Only a qualified applicant may file an application to enter into a development agreement. A quali- fied applicant is a person, including any authorized agent, who has a legal or equitable interest in the real property which is the subject of the development agreement, provided that in all instances the owner(s) of fee title of the real property shall join in the application or the development agree- ment shall be conditional upon the close of escrow vesting fee title to the property in the Developer. The Director may require an applicant to submit proof of interest in the real property and of the au- thority of any agent to act for the applicant.
