RESOLUTION NO. 4391-12 <br />A RESOLUTION APPROVING DESIGNATION OF <br />THE ALAMEDA COUNTY SOURCE REDUCTION AND RECYCLING BOARD <br />AS THE LOCAL TASK FORCE UNDER STATE LAW <br />FOR THE PURPOSE OF REVIEWING AND COMMENTING ON <br />COUNTY INTEGRATED WASTE MANAGEMENT PLAN AMENDMENTS <br />WHEREAS, California Public Resources Code Section 40950 requires the creation of a Local <br />Task Force ("LTF") to comment on possible County Integrated Waste Management Plan amendments <br />and to otherwise provide non-binding guidance with respect to integrated solid waste planning; and <br />WHEREAS, the Alameda County Waste Management Authority ("ACWMA"), via Section 5-g. <br />of the Joint Powers Agreement ("JPA") creating it, is empowered to make replacement appointments <br />to the LTF, subject to approval by the Alameda County Board of Supervisors and a double majority of <br />the Cities in the County; and <br />WHEREAS, the ACWMA has appointed the Alameda County Source Reduction and Recycling <br />Board ("RB") as the LTF, as an efficiency -improving measure in government that eliminates the need <br />for separate ACWMA committee and task force meetings, pending approval by the County and a <br />double majority of the Cities in the County; and <br />WHEREAS, the Alameda County Charter Subsection 64.130.C., states that in order to avoid <br />unnecessary administrative duplication, the County Board of Supervisors shall seek the consent of a <br />double majority of the Cities for the RB to serve as the LTF, but in the event such appointment does <br />not occur, the RB shall review any recommendations of the LTF regarding source reduction and <br />recycling. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Union City hereby <br />approves designation of the Alameda County Source Reduction and Recycling Board as the Local <br />Task Force required by State Law. <br />PASSED, APPROVED AND ADOPTED by the City Council of the City of Union City at a <br />regular meeting held on the P day of November 2012, by the following vote: <br />AYES:. <br />Councilmembers <br />Green <br />NOES: <br />None <br />ABSENT: <br />None <br />ABSTAIN: <br />None <br />ATTEST: <br />Duncan, Ellis, and Navarro, Vice Mayor Gacoscos, Mayor <br />RE14EE ELLIOTT <br />City Clerk <br />mayor <br />APPROVED AS TO FORM: <br />BENJA T.
