(2622) <br /> On motion by Council Member Perry, who moved its approval , seconded by <br /> Council Member Kerr, and carried by a majority vote (6) , with Council <br /> Member Galvan absent (1) , the City Council approved the Americans with <br /> Disabilities Act (ADA) Transition Plan Update. <br /> E. Approval of Work Session Items Requiring Action. <br /> None <br /> F. Report on Closed Session Actions Taken. <br /> The City Attorney said the City Council conducted the City Manager's <br /> Performance Evaluation in Closed Session; no action was taken. <br /> The City Attorney further stated that the City Council considered <br /> potential litigation which had arisen after the preparation of the <br /> Agenda. <br /> 8. PUBLIC HEARINGS <br /> A. An Interim Ordinance Prohibiting Any New Uses and Declaring This <br /> Ordinance to Be an Urgency Measure for the Preservation of the Public <br /> Peace, Health, and Safety for Plaza 2 Redevelopment Plan, Area 5, <br /> Expansion Area D (extends prohibition of truck terminals adjacent to <br /> residential properties in Area 5, Expansion Area D of the Plaza 2 <br /> Redevelopment Area through November 17, 1995) . <br /> This being the time and place for the Public Hearing on the above <br /> matter, Norm Weisbrod, Associate Planner, said the City Council <br /> approved an Interim Ordinance prohibiting truck terminals in <br /> Redevelopment Area 5, Expansion Area D of Plaza 2 at its December 19, <br /> 1994 meeting. He described the boundaries of the area and said the <br /> purpose of the proposed Interim Ordinance is to extend the prohibition <br /> and allow staff to prepare an Amendment to the Redevelopment Plan. He <br /> said a Public Hearing is tentatively scheduled for February 27, 1995, <br /> and described the complex noticing requirements. <br /> Council Member Kerr said the truck terminal is a legal non-conforming <br /> use and asked if this is designed to put them out of business. <br />
