The <br /> City Attorney said they must. Council Member Loeffler said he <br /> understands the hardship on the property owner and has a problem with <br /> the consistency of variances in the area. He said he believes other <br /> variances have been issued in the area. <br /> Mayor Corbett thanked Mrs. Shih for being part of the process and said <br /> no one thinks she intended to break the law. She said the City Council <br /> understands Mrs. Shih's issues and concerns and are sensitive to them. <br /> She said the Zoning Code does not give them a lot of flexibility, and <br /> she has not heard anything that indicates they have the necessary facts <br /> for the findings in this matter. She said these types of issues may <br /> affect the value of the adjacent property owners, so the Council must <br /> balance everyone' s needs while maintaining the integrity of the Zoning <br /> Code. She said she did not find the facts to allow the Variance. <br /> Council Member Perry asked how long it would take to obtain a staff <br /> report regarding other variances. Mr. Emslie said it could be provided <br /> at the next regular meeting. <br /> The following Motion was then introduced: <br /> Minute Order No. 95-13, Matter of Appeal by R. Shih of the Board of <br /> Zoning Adjustments' Denial of V-94-5; Variance; to Reduce the Required <br /> Rear Yard Setback from 10 Feet to 5 Feet to Retain an Existing <br /> Addition, Which Includes a Family Room, Bedroom/Study and Bathroom; <br /> 14289 Santiago Road; Assessor's Parcel Number 80G-928-15; R. Shih; RS <br /> (Residential Single-Family) District. (1005) <br /> On motion by Council Member Loeffler, who moved its approval , seconded <br /> by Council Member Galvan, and carried by a majority vote (7) , the City <br /> Council continued the Public Hearing to the April 3, 1995, City Council <br /> Meeting. <br /> 9. CITY COUNCIL COMMENTS <br /> A. Council Member Polvorosa said he attended the Cabrillo Day Celebration <br /> on the Mayor's behalf. He said he also attended the installation of <br /> officers at the Boys' Club, and it was one of the largest turnouts they <br /> have had in a number of years - a very worthwhile event. <br /> B. Council Member Kerr said he had asked, at the last City Council <br /> Meeting, what the status of work at the Washington Manor Tot Lot was <br /> and was happy to see work has begun. <br /> C. Council Member Kerr said, at the last meeting, Council Member Polvorosa <br /> brought up the matter of crime in business and industrial areas, and <br /> the Council asked for advice from the Police Department about what can <br /> be done. He said the Police Chief has informed him there is quite a <br /> bit being done. Mayor Corbett said a Work Session presentation will. be <br /> made at the next City Council Meeting. <br />
