Steve <br /> Emslie, Planning Manager, said no City funds would be utilized. He <br /> said the applicant would like to participate in the Design Assistance <br /> Program which is funded through CDBGr-and he explained the criteria for <br /> participation. Mr. Filipovich said he is concerned about taxpayers <br /> equity and has no objection to the project. <br /> There being no further comments from the public, on motion of Council <br /> Member Kerr, seconded by Council Member Perry, and carried by a <br /> majority vote (7) , the Public Hearing was closed. <br /> The following Motion was then introduced: <br /> Minute Order No. 95-62, Matter of PD-95-2 and A-95-3; Planned <br /> Development; New Construction of a Single-Story Addition of <br /> Approximately 8,500 Square Feet to an Existing, Two-Story, Retail Music <br /> Store; Construction of a Parking Lot with 28 Spaces; Demolition of Two, <br /> Existing, Single-Family Homes; and A-95-3; Amendment; Rezone from CC <br /> Community Commercial District and RS Residential Single-Family District <br /> to CC (PD) Community Commercial Planned Development Overlay District; <br /> Properties Located at 14417 East 14th Street, 1380 - 144th Avenue, and <br /> 1390 - 144th Avenue; Assessor's Parcel Numbers 77D-1456-3-2, 77D-1456- <br /> 16-1, 77D-1456-17-1 ; Doug and Dianne Lee dba Music Unlimited (Property <br /> Owner) ; Ioan Tet (Property Owner) ; Collaborative Design Architects, <br /> Inc. , Applicant. (1009) <br /> On motion by_Council Member_ Perry, who moved its approval , seconded by <br /> Council Member Galvan, and carried by a majority vote (7) , the City <br /> Council certified the Negative Declaration as complete and in <br /> compliance with CEQA requirements and approved PD-95-2 and A-95-3, <br /> subject to the Conditions of Approval . <br /> A. Matter of City's 1995-96 Appropriation Limit. <br /> This being the time and place for the Public Hearing on the above <br /> matter, John Jermanis, Finance Director, presented the staff report and <br /> said the purpose of the hearing was for the Council to adopt the 1995- <br /> 96 spending limitation, as required by State law. He said the City <br /> could spend an additional $18 million if it had the revenue. He said <br /> the proposed spending limitation is $57,589, 114. <br /> The Hearing was then opened to the Public. <br /> There being no comments from the public, on motion by Council Member <br /> Polvorosa, seconded by Council Member Myers, and carried by a majority <br /> vote (7) , the Public Hearing was closed. <br />
