CALL TO ORDER <br /> 2. PLEDGE OF ALLEGIANCE TO THE FLAG <br /> 3. ROLL CALL <br /> PRESENT: Council Members Galvan, Kerr, Loeffler, Myers, Perry, Polvorosa; <br /> Mayor Corbett <br /> ABSENT: None <br /> 4. PRESENTATIONS <br /> None <br /> 5. PUBLIC COMMENTS <br /> Public Comments are limited to 5 minutes per person. The public is invited <br /> to make any comments related to Agenda items (including San Leandro <br /> Redevelopment Agency, San Leandro Parking Authority, and San Leandro <br /> Industrial Development Authority) or other items of public interest at this <br /> time. Comments regarding Public Hearing items will be heard during the <br /> Public Hearing portion of the Agenda. <br /> A. Calvin Brown, Western Specialty Waste, 9267 Emerald Vista Drive, Oak <br /> Grove, spoke regarding New Business Item D. He said the resolution <br /> will have a direct negative effect on his business. He discussed his <br /> contact with City staff and the activities that have taken place <br /> related to his application for a conditional use permit for his <br /> business operation. He said the matter was scheduled to be heard by <br /> the Board of Zoning Adjustments but has been delayed pending City <br /> Council action on the resolution. He said, if the resolution is <br /> passed, the prohibition could be in effect for as much as two years. <br /> He said his operation complies with the existing ordinance, and he <br /> requested the City Council delay voting on the matter until his company <br /> has time to reevaluate their application and work with staff, the City <br /> Attorney, and his own attorney to resolve this matter. <br /> Mayor Corbett said this matter is pending before the Board of Zoning <br /> Adjustments and requested direction from the City Attorney. Steve <br /> Mattas, Assistant City Attorney, said he believed Item E, the Interim <br /> Ordinance, more directly affected Mr. Brown. He said this is an <br /> interim ordinance which prohibits new conditional use permits for up to <br /> 45 days. He said because this application is before the Board of <br /> Zoning Adjustments, it is inappropriate for the City Council to discuss <br /> it at this time. <br />
