However, he said <br /> this situation is just the opposite; the re-zone would go from more <br /> restrictive to less restrictive, so conditions that pertain to the I-P <br /> zoning would not carry over to the I-2 zone, and the property owner <br /> would have no legal obligation to carry on with any improvements. He <br /> said property may not be zoned conditionally. He said, when property <br /> is re-zoned, the only conditions are those which are specific to the <br /> Zoning Ordinance. <br /> Council Member Faria asked, if the property were re-zoned to I-2, would <br /> it be the new or old I-2 zone. Mr. Meyers said the zoning would be the <br /> current I-2 because, although the new Zoning Code is adopted, it is not <br /> operative until the Zoning Maps themselves are adopted. <br /> Council Member Myers asked, if this property were re-zoned to I-2, <br /> could the City not make a Condition that they keep the I-2 <br /> improvements. Mr. Meyers said, if they re-zone the property and the <br /> new Zoning Code then comes before them, when the property is <br /> redeveloped they would have to comply with the new Zoning Code. <br /> Norm Weisbrod said there are three industrial zones in the new Zoning <br /> Code and these properties could be placed in any of them. He described <br /> the setbacks, landscaping, and building coverages in the three zoning <br /> districts. <br /> Steve Meyers, in response to Council questions, said that, until the <br /> City Council adopts the Zoning Maps, the current provisions of the <br /> Zoning Ordinance would be in effect for these properties. In response <br /> to questions, Mr. Weisbrod said any development in. the ' I-P District <br /> requires Site Development Review by the Site Development Subcommittee. <br /> He said there were conditions relating to truck loading, parking, <br /> backing on and off the site, employee parking, etc. , that were applied <br /> to the Federighi property under the I-P zone. He said, if the property <br /> is re-zoned to I-2, those Conditions will no longer apply because the <br /> I-2 General Industrial District does not require such conditions. <br /> Council Member Perry asked if the City Council could apply an interim <br /> zone on the properties indicating that they are being studied until the <br /> • <br /> new Zoning Code is adopted. Mr. Meyers said the matter that was <br /> appealed to the City council is on the re-zoning to I-2, and the City <br /> Council would have to do a new Hearing to apply an interim study zone. <br /> He said the City Council could re-zone the property and not make the <br /> Ordinance operative until the new Zoning Code was operative or they <br /> could table the matter until the new Zoning Maps are approved. <br /> Council Member Faria asked if Zoning Maps would be adopted in whole or <br /> in pieces. Steve Emslie, Planning Manager, said the Maps would be <br /> adopted in whole and would probably be presented to the Planning <br /> Commission around May or June of this year and to the City Council in <br /> July or August.
