Ordinance No. 93-013, An Ordinance Adding Chapter 12, Title VII to the <br /> San Leandro Municipal Code Regulating Grading, Excavations, Fills, and <br /> Erosion and Pollutant Control Related Thereto (regulates grading, <br /> excavations, fills, erosion and pollutant controls in the City of San <br /> Leandro) . (1413) <br /> Introduced by Council Member Corbett, who moved that it be passed to <br /> print, seconded by Council Member Perry, and carried by the following <br /> called vote: <br /> AYES: Council Members Corbett, Kerr, Myers, Nahm, Perry, Polvorosa; <br /> Mayor Faria ( 7 ) <br /> NOES: None ( 0 ) <br /> ABSENT: None ( 0 ) <br /> B. An Ordinance Amending Title III, Chapters 6 and Chapter 7 of the San <br /> Leandro Municipal Code Related to Garbage Collection Within the <br /> Corporate Limits of the City of San Leandro (The proposed Ordinance <br /> would make the existing garbage collection provisions of the San <br /> Leandro Municipal Code applicable to all areas within the City limits. <br /> One effect of the proposed Ordinance would be to delete an existing <br /> exclusion from compliance with Municipal Code provisions relating to <br /> garbage collection that applies to areas within the City limits, but <br /> that are currently served by the Oro Loma Sanitary District) . (1078) <br /> Mayor Faria passed the gavel to Vice Mayor Polvorosa and indicated the <br /> Oro Loma Sanitary District is a customer of his business, and he would <br /> be abstaining from participation on this matter. <br /> Council Member Kerr indicated he would also abstain because this is a <br /> conflict of interest for him. <br /> Mike Oliver, City Manager, said the City of San Leandro serves about <br /> 60%o of the corporate limits with refuse and garbage. He said 400 of <br /> the corporate limits is in the Oro Loma Sanitary District, which <br /> existed prior to incorporation of the area into San Leandro. He said <br /> this Ordinance would require franchising those refuse collection <br /> activities with the City of San Leandro instead of Oro Loma Sanitary <br /> District. He said a staff report was presented to the City Council in <br /> June regarding this matter. He said there is no intention for this <br /> action to result in increased costs to any customers in the Oro Loma <br /> Sanitary District or any intent to replace or modify the existing <br /> franchise agreement or term. He said the intention of the action is to <br /> be transparent to the users, residents, and businesses as to where the <br /> franchise fee is paid and to whom. He said those funds are collected <br /> by Oro Loma Sanitary District and are not spent in the City of San <br /> Leandro. He said they cannot subsidize sewer service charges or assist <br /> with City of San Leandro AB 939 service, which the City must supply to <br /> the Oro Loma Sanitary District area in San Leandro. <br />
