Kateri Harrison, 430-1/2 Breed Avenue, noted the Exhibits to the <br /> Roberts' Landing Development Agreement included Exhibits related to the <br /> General Plan, the Zoning Ordinance, the Grading Ordinance, and <br /> Conditions of Approval and asked if the City Council was re-adopting <br /> those items as part of its action tonight. <br /> Steve Meyers, City Attorney, said Exhibit D was merely a list of <br /> documents, rules, regulations, ordinances, etc. , which were in force <br /> and in place as of the date of adoption of the Development Agreement <br /> and said those items would govern the Agreement and any actions of the <br /> City Council with respect to it but were not being re-adopted. <br /> J. Lou Filipovich, 15376 Laverne Drive, said he felt five minutes per <br /> speaker was not adequate time if speakers wanted to talk about more <br /> than one item. He asked if the Roberts' Landing Development Agreement <br /> would affect anything between a buyer and a seller of the property and <br /> asked if any Conditions would be put on the property as part of the <br /> Development Agreement. Steve Meyers said the Development Agreement <br /> guarantees to the owner of the property the right to develop the <br /> property in accordance with entitlements and improvements of the <br /> property, as approved by the City Council . Mr. Filipovich asked if <br /> action related to panhandling would only take place upon a citizen's <br /> complaint or whether someone could just phone the Police Department and <br /> say panhandling is occurring. Steve Meyers said violation of this <br /> Ordinance would be an infraction or a misdemeanor and generally must be <br /> committed in the presence of a Police Officer in order to make an <br /> arrest. Mr. Filipovich said this means that there will be slap suits. <br /> 6. CONSENT CALENDAR <br /> A. The Minutes of the meeting of September 27, 1993, were approved as <br /> submitted. <br /> B. The Minutes of the meeting of October 4, 1993, were approved as <br /> submitted. <br /> C. Resolution No. 93-221, Resolution of Final Acceptance and Release of <br /> Maintenance Bond for Public Works Service Center Vehicle Shelters, <br /> Project No. 92-8304 (provides for final acceptance of work from CSB <br /> Construction, Inc. , after completion of one-year guarantee period) . <br /> (2704) <br /> Introduced by Council Member Kerr, who moved its adoption, seconded by <br /> Council Member Corbett, and carried by the following called vote: <br /> AYES: Council Members Corbett, Kerr, Myers, Nahm, Perry, Polvorosa; <br /> Mayor Faria ( 7 ) <br /> NOES: None ( 0 ) <br /> ABSENT: None ( 0 ) <br />
