He said the City Council would hear from <br /> Christopher Burdick on behalf of his clients. He described his <br /> relationship with Mr. Burdick. He said the City Council was not being <br /> asked to resolve questions that in any way impinge on the character or <br /> credibility of the Fire Fighters or Police Officers, and all of the <br /> City's safety personnel are fine people. <br /> He said, from the employer's perspective, the issue is one of the City <br /> trying to protect its ability to adequately finance all of its required <br /> services in these dire economic times. <br /> He asked Mr. Tarverto distribute the following documents to the City <br /> Council and said these documents outline the presentation to be made. <br /> 1 . Matter of Proposed Amendment to City Charter Regarding" Interest <br /> Arbitration Impasse Hearing, Factual Background, March 5, 1992, and <br /> 2. Differences Between Proposals at Last Meet-and-Confer Session <br /> (3/2/92) . <br /> He said, in Fall of 1991, Lloyd Hathaway asked that a petition be <br /> circulated for binding arbitration. He referred to this as the <br /> "Hathaway Amendment." He said the petition was circulated among the <br /> citizens of San Leandro and submitted to the City Clerk on January 24, <br /> 1992. The petition was verified on February 10th by the City Clerk. <br /> He said on January 27th, Glenn Tarver sent a letter to the POA and FFA <br /> with a proposal the employer wished to be considered. He said the City <br /> has a certain obligation to meet and confer. He said the letter <br /> offered the opportunity to meet and confer and asked for a response by <br /> February 10. He said the POA responded on February 3rd and the FFA on <br /> February 10th. He said a meeting was set with both groups for February <br /> 21, 1992. <br /> He said on February 21st, the first meet and confer session with both <br /> Associations was held. The spokesperson for the FFA and POA was Chris <br /> Burdick. He said Mr. Burdick raised several questions about the <br /> process of negotiations and content of the employer's measure. Mr. <br /> Burdick was concerned regarding the City's time constraints. Mr. <br /> Rungis said the matter was to be scheduled for City Council approval on <br /> March 2, 1992 and that this was a final date because it was the last <br /> regular City Council meeting where this could be done. Mr. Rungis said <br /> he also answered questions about the City measure and then modified the <br /> City's original proposal to reflect the questions, to clarify, and in <br /> some instances change, the City's position. He said that, at the end <br /> of the meeting, Mr. Burdick asked if he could have an opportunity to <br /> review and respond at a second meeting. Mr. Rungis said he (Mr. <br /> Rungis) offered the dates of February 22, 23 and 24, and they settled <br /> on the 25th. He said Mr. Tarver was sent a letter (Attachment G) and <br /> responded to it (Attachment J) . <br />
