Minutes - San Leandro City Council Meeting - April 16, 1992 Page - 2 - <br /> 6. NEW BUSINESS <br /> A. Matter of Memorandum of Understanding Between the City of San Leandro, <br /> Citation Homes, and the Port of Oakland. <br /> A motion was made by Council Member Glaze, seconded by Council Member <br /> Santos, to approve the Memorandum of Understanding. Council Member <br /> Glaze said he wished it to be on the record, it is the City Council 's <br /> intention that, when the final wording for the agreement is negotiated, <br /> it include wording related to disclosure provisions. <br /> Council Member Santos said he agrees; it is important the buyers of <br /> homes at the Citation development be protected because he is sensitive <br /> to the problems from airport noise. He referred to paragraph 3.7. He <br /> said it states San Leandro agrees to cooperate with the Port in <br /> adopting procedures to ensure prospective property owners are informed <br /> from time to time of current and anticipated airport-noise impacts. He <br /> said the biggest problem with noise from the airport is caused by <br /> general aviation aircraft flying at all hours of the night. He <br /> suggested future City Councils take steps to protect citizens from <br /> excessive noise. He said he wanted to be assured this agreement did <br /> not preclude him or any other citizen from taking action as a private <br /> citizen if he feels the noise from the airport is excessive. <br /> Mr. Meyers said this agreement would not impair the ability of any <br /> individual citizen or the City Council , representing the citizens, from <br /> raising issues related to noise now or from future airport activities. <br /> He said this is an agreement to work cooperatively with the Port, but <br /> it does not bind the City Council in any respect. <br /> Council Member Corbett pointed out there are already State laws that <br /> require disclosure but said there should be Conditions in the CC&R's <br /> for the development as well , and this should be part of the <br /> negotiations. Mr. Meyers concurred. <br /> The following Motion was then approved: <br /> MINUTE ORDER NO. 92-30 (2690) <br /> MATTER OF MEMORANDUM OF UNDERSTANDING <br /> BETWEEN THE CITY OF SAN LEANDRO, <br /> CITATION HOMES, AND THE PORT OF OAKLAND <br /> REGARDING ROBERT'S LANDING PROPERTY <br /> On motion by Council Member Glaze, who moved its approval , seconded by Council <br /> Member Santos, and carried by the following called vote, the City Council <br /> approved the Memorandum of Understanding Between the City of San Leandro, <br /> Citation Homes, and the Port of Oakland regarding the Robert's Landing property. <br /> AYES: Council Members Corbett, Faria, Glaze, Perry, Polvorosa, Santos; <br /> Mayor Karp ( 7 ) <br /> NOES: None ( 0 ) <br /> ABSENT: None ( 0 ) <br />
