" <br /> In response to a question from Council Member Glaze, staff said two <br /> ARK's (emergency-supply storage facilities) were required, with a <br /> possible third, depending upon the location of the shoreline trail . <br /> Council Member Glaze asked if there is a need for a sound buffer versus <br /> a sound wall to stop reflection of sound. <br /> Council Member Perry asked questions regarding ponding. <br /> Steve Foreman, Western Ecologic, said ponding may increase pollutants. <br /> He said the Regional Water Quality Control Board issues appropriate <br /> permits and designates appropriate monitoring. He said they are <br /> currently proposing a 10-year program. He said the City would ensure <br /> that the monitoring occurs. He said the wetlands treatment program <br /> that has been developed is intended to bio-strip-away pollutants before <br /> they enter the marsh and is based on Regional Water Quality Control <br /> Board data. He said the water will be treated on the site, before it <br /> enters the Bay. <br /> Council Member Perry discussed the City's liability in the Sandpiper <br /> contamination case and asked if the City was protected in the CC&R's <br /> from future liability if contamination is not mitigated. Steve Meyers <br /> said the City is party to the Sandpiper because the City owns part of <br /> the property. He said at the time Sandpiper was built, there was no <br /> requirement for subsurface investigations. He said the toxic studies <br /> and the PEA will provide the best available information. <br /> Council Member Perry asked if greater standards than those of the <br /> Uniform Building Code would be required to address acceleration and <br /> amplification. <br /> In response to a question from Council Member Glaze, Steve Meyers said <br /> staff will be requesting direction for further negotiations with EBRPD <br /> and the State Lands Commission, pending the determination of the Corps <br /> of Engineers, related to monitoring of the wetlands. State Lands has <br /> said they will require a Management Plan before they will release <br /> property to anyone. <br /> Council Member Glaze asked, if the City Council approved the General <br /> Development Plan tonight, but the Corps of Engineers did not allow the <br /> fill project, could the Council require greater buffer zones, thus <br /> changing the density of the project? Mr. Meyers said the Council could <br /> change the density of the project if there are significant changes as <br /> a result of the Corps' determination. He said the applicant might need <br /> to request an amendment. He said the overall approval being requested <br /> of the City Council tonight was for density and size of the project. <br />
