Minutes - San Leandro City Council Meeting - June 15, 1992 Page - 17 - <br /> NEW BUSINESS (continued) <br /> RESOLUTION NO. 92-162 (2323) <br /> RESOLUTION APPROVING CONTRACT SERVICES <br /> AGREEMENT WITH THE ENVIRONMENTAL FIRM <br /> CH2M HILL TO PREPARE AN <br /> INITIAL STUDY AND NEGATIVE DECLARATION <br /> Introduced by Council Member Corbett, who moved its adoption, seconded by Council <br /> Member Kerr, and carried by the following called vote: <br /> AYES: Council Members Corbett, Kerr, Myers, Perry, Polvorosa; <br /> Mayor Karp ( 6 ) <br /> NOES: Council Member Faria ( 1 ) <br /> ABSENT: None ( 0 ) <br /> K. Matter of Rubbish Franchises <br /> Steve Meyers, City Attorney, said an amended page 19 of the amended <br /> franchise agreement with San Leandro Disposal had been distributed to <br /> the City Council , reflecting a last minute correction to Section 17, AB <br /> 939 Indemnification. He also recommended an additional change to <br /> Section 18 of the agreement, as follows (underline indicates change) : <br /> "The Contractor shall comply with all provisions of applicable state <br /> law, local ordinances, plans and rules adopted by the City Council <br /> pursuant to AB 939, . . . " Council Member Kerr requested that this <br /> section be further amended as follows: "Failure of Contractor to <br /> comply with such laws, ordinances, plans or rules adopted by the City <br /> Council shall be . . . " <br /> The following Resolutions and Ordinance were then introduced: <br /> RESOLUTION NO. 92-012 (1494) <br /> RESOLUTION APPROVING AMENDED AGREEMENT <br /> AND APPROVING ASSIGNMENT <br /> (SAN LEANDRO DISPOSAL COMPANY) <br /> Introduced by Council Member Polvorosa, who moved its adoption, seconded by <br /> Council Member Kerr, and carried by the following called vote: <br /> AYES: Council Members Corbett, Faria, Kerr, Myers, Perry, Polvorosa; <br /> Mayor Karp ( 7 ) <br /> NOES: None ( 0 ) <br /> ABSENT: None ( 0 ) <br />
