Minutes - San Leandro City Council Meeting - July 6, 1992 Page - 16 - <br /> PUBLIC HEARINGS (continued) <br /> Mr. Weisbrod said the proposed project is a three-story, 36-unit <br /> condominium development over a depressed parking garage. He described <br /> the setbacks for the project. He said the parking ratio is 1 .9, and the <br /> required ratio is 2 spaces per unit. He said four guest parking spaces <br /> in front of the building are proposed, as well as a driveway for <br /> passenger loading. <br /> He said the Planning Commission denied the project because they felt it <br /> was out of scale with the adjacent single-family homes. He said they <br /> were concerned about the 41' height of the building. They felt the area <br /> should remain commercial and this project would change the commercial <br /> nature of MacArthur Boulevard. He presented slides showing the existing <br /> site and improvements and the surrounding neighborhood. <br /> Council Member Perry asked what would be visible from the third floor. <br /> Mr. Weisbrod said the third floor units would have balconies. He said <br /> evergreen trees would be planted to screen the view into adjacent yards. <br /> He said the freeway would be at approximately the level of the second <br /> floor of the building and the top floor would look at the freeway. <br /> Council Member Myers noted a letter which had been received and which <br /> referred to potential problems with shadows and loss of sunlight. He <br /> asked how much sunlight the properties behind the building would lose. <br /> Mr. Weisbrod said there would be some loss in the early morning, but <br /> with a 35-foot setback, the loss would not occur after about 9 or 10 <br /> a.m. <br /> Mayor Karp referred to the parking ratio requirements in Section 7-3- <br /> 522.3 of the Zoning Code. He noted that the Council had changed the <br /> code for the development on Haas Ave. He said, with the density <br /> proposed for this project, there should be eleven on-street parking <br /> spaces and asked why this was not being required. He also questioned <br /> why only one parking space in the garage would be assigned to each unit. <br /> Mr. Weisbrod explained that the parking in the garage would be assigned <br /> based on the needs of the residents in the building. He said, after <br /> sale of all of the units, it could be assigned for guests. Mayor Karp <br /> asked why two spaces were not assigned for each of the two-bedroom <br /> units; Mr. Weisbrod said the CC&R's could be modified. Mr. Weisbrod <br /> said a Planned Development gives the City Council discretion as to <br /> required parking other than that required in the Zoning Code. <br /> In response to a question from Council Member Myers, Mr. Weisbrod said <br /> the CC&R's could require that it would be up to the homeowners <br /> association to assign parking spaces on an as-needed basis. <br /> Council Member Kerr said it appears the project meets the requirements <br /> of the C-2 zoning, the General Plan, and the North Area Guidelines, <br /> excepting height and density, and questioned why a Conditional Use <br /> Permit and Planned Development approval were required. Mr. Weisbrod <br /> said a Conditional Use Permit was required, and staff had recommended <br />
