He said the conclusions in the report are not confident. He <br /> said the report is only valid for two years, and he is concerned the <br /> work would start at or near the conclusion of the two-year period and <br /> would not be done until after two years. He said the preliminary <br /> report leaves doubt as to the adequacy of the site. He said he was <br /> concerned how the project would be carried out and wanted to make the <br /> builder adhere to all standards. <br /> Mr. Fong, 1623 Edgehill Court, noted he has had to have three, separate <br /> repairs on his property since 1977. He said the soils report on his <br /> property indicated there was some kind of depression or ravine that was <br /> filled. He said he had to have piers as deep as 30 feet installed. He <br /> said, when his house was built, the drainage was put in upside down, <br /> and a number of problems have resulted. He said he wanted to make sure <br /> the City really looked into the drainage problems in the area, and he <br /> said he felt the slope of the property was more like 30%. <br /> Scott Banner and Mae Roberts, 1490 Montrose Drive, spoke. Ms. Roberts <br /> said her home is immediately below the subject property. She said she <br /> was concerned he was going to build a driveway around the edge of her <br /> property and said she did not like to see a driveway at eye level from <br /> her swimming pool . <br /> Mr. Banner said the driveway will go right through Ms. Roberts' back <br /> yard, trees will be taken down, and her privacy will be gone. He said <br /> it would be 30 feet from her pool to the driveway. <br /> Mayor Karp noted that, when you buy next to a vacant lot, you take the <br /> risk of eventually losing the view, trees, etc. He said you cannot <br /> control your neighbor, and you don't want your neighbor to control you. <br /> Ms. Roberts asked if there was any ruling regarding how close her <br /> neighbor could build his driveway to her property line. Mr. Silva said <br /> the Zoning Code requires a 10-foot setback on the side yard. Ms. <br /> Roberts said she bought her house right before the earthquake at peak <br /> prices, and she is concerned this project will de-value her property. <br /> Steve Emslie, Planning Manager, said the set backs are 20 feet for the <br /> front yards, 5 feet for interior side yards, and 15 feet for the rear <br /> yards. <br /> Loong-Fah Lu, the Applicant, said he provided 59 names and addresses of <br /> persons in favor of the project. He said only 6 families are opposing <br /> it. He said the slope of the site is the reason the neighbors are <br /> opposing it. He said he bought this property three years ago, and his <br /> engineers have been working with the City for two or three years. He <br /> said they have checked every point.
