Minutes - San Leandro City Council Meeting - August 17, 1992 Page - 6 - <br /> NEW BUSINESS (continued) <br /> Mike Oliver, City Manager, said the purpose of this contract is to <br /> proceed with development of the assessment district regardless of the <br /> type of development that occurs. <br /> Steve Meyers, City Attorney, said this contract will allow City <br /> management to direct the consultant to prepare documentation to provide <br /> for either a construction or an acquisition district. He said it <br /> provides flexibility that allows the project to proceed. He said an <br /> acquisition district acquires improvements once they have been <br /> constructed and a construction district is formed to raise funds to <br /> construct improvements . <br /> Council Member Faria asked if the type of construction would have any <br /> affect on the boundaries of the assessment district. Mr. Meyers said <br /> it would not. He said the only reason the district is done this way is <br /> because it affects the economics of the transaction between the City <br /> and the developer. He said this would provide for any infrastructure <br /> improvements needed, regardless of the type of development. He said <br /> the mechanics of the district do not change. <br /> Council Member Faria asked if there were any other development plans <br /> besides the ball park before the City. <br /> Mr. Oliver said there were not, but this contract would give the City <br /> a variety of options to pursue. He said it would not be necessary to <br /> proceed with the assessment district until there was a formal <br /> development agreement. <br /> Council Member Faria said he was concerned regarding the professional <br /> liability provisions in the contract and that the contractor could <br /> self-insure. <br /> Bill Silva, City Engineer, said the contractor is not designing any <br /> facilities. The City is asking him to provide a report, not to proceed <br /> with any physical construction, and this type of self insurance is <br /> common for this type of contract. <br /> Council Member Perry noted that the staff report said the cost of the <br /> work was $30,000, but the Exhibit B payment said $35,000. Mr. Silva <br /> said the Exhibit would be corrected to read $30,000. <br />
