She recommended denial of the Appeal and said Mr. Saberi would <br /> then have to cease all activity and be required to get a new Conditional Use <br /> Permit. She said he now has no Business License and no Underground Tank <br /> Permit for this location. <br /> The Hearing was then opened to the public. <br /> Tom Saberi , the son of the property owner, Mr. Andy Saberi , 1045 Airport <br /> Boulevard, South San Francisco, said they had submitted all of the evidence <br /> they had available to submit and no further documentation was available. <br /> The City Council asked questions regarding State Board of Equalization <br /> Reports and utility bills. <br /> There being no further comments from the public, on motion of Council Member <br /> Santos, seconded by Council Member Suchman and carried unanimously, the <br /> Public Hearing was closed. <br /> On motion of Council Member Jardin, seconded by Council Member Glaze and <br /> carried unanimously, the Board of Zoning Adjustments recommendation was <br /> upheld and the Appeal was denied. <br /> d. Matter of Assessment District No. 94, 139th Avenue. Continued from City <br /> Council Meeting of January 2, 1990. <br /> This being the time and place for the Public Hearing on the above matter, <br /> Bill Silva, City Engineer, said the matters before the City Council were <br /> continued Hearings on this Assessment District that would result in three <br /> basic actions, including the matter of the Hearings, confirming the <br /> assessments, and authorizing the acquisition of property. He noted <br /> Mr. Zenklusen's protest had been withdrawn, with the understanding that 139th <br /> Avenue would be posted for no parking. <br /> The Hearing was then opened to the public. <br /> Mrs. Vitale reinforced her protest to the method of allocation of costs and <br /> said she felt it should be based upon the square footage of the properties <br /> involved. <br /> There being no further comments from the public, on motion of Council Member <br /> Santos, seconded by Council Member Jardin and carried unanimously, the Public <br /> Hearing on Whether the Public Convenience and Necessity Require the Ordering <br /> of Proposed Improvements Without First Complying with the Provisions of the <br /> Special Assessment Investigation Limitation and Majority Protest Act of 1931 ; <br /> the Hearing of Protests Relative to Resolution of Intention No. 88-127, <br /> Resolution of Intention to Order Certain Public Improvements; and the <br /> Hearings Regarding Proposed Changes in Work to Be Done; were closed. <br />
