Minutes - San Leandro City Council Meeting - September 17, 1990 Page - 8 - <br /> PUBLIC HEARINGS (continued) <br /> b. Matter of CU-66-6 (4th Modification) ; Baker's Square Restaurant; 15501 <br /> Hesperian Boulevard; Conditional Use; to Remodel the Building Exterior, to <br /> Construct Additions Totaling 427 Square Feet and to Increase Customer <br /> Seating; HPC Architecture, Jeffrey Escott -- Appeal . <br /> This being the time and place for the Public Hearing on the above matter, <br /> Gaye Quinn, Acting Director of the Building and Planning Department, noted <br /> that this was an Appeal of certain conditions related to an addition to the <br /> Baker's Square Restaurant at the northwest corner of Hesperian and Lewelling <br /> Boulevard. She said the Board of Zoning Adjustments had approved this <br /> Conditional Use on July 19, 1990, and that the Applicant was appealing <br /> requirements related to landscaping, street trees, and paving. She said the <br /> basic issue was a matter of interpretation of the General Plan and the Board <br /> of Zoning Adjustments had determined that upgrading could be required for <br /> this property and was consistent with the General Plan. <br /> Ms. Quinn then discussed the Site Plan and described prior enforcement <br /> problems with dust from the unpaved area behind the Baker's Square <br /> Restaurant. She said the addition to Baker's Square was a significant <br /> impact, but Baker's Square and the architect indicated they did not wish to <br /> comply with the Conditions of Approval . <br /> The Hearing was then opened to the public. <br /> Nelson Hilgar, HPC Architecture, 2150 No. Fifth Street, San Jose, <br /> representing Baker's Square, said they do plan to landscape the area in front <br /> of the building and adjacent to the driveway, but they do not feel they <br /> should be required to put trees along the entire length of Hesperian <br /> Boulevard. They said they are lease holders of only one portion of the <br /> property. They said they were willing to give up the existing sign and <br /> install a monument sign, as requested. They also said they were willing to <br /> put a fence along their lease line adjacent to the unpaved portion of the <br /> property; however, they said the unpaved area belongs to Target, not to <br /> Baker's Square. <br /> John Justino, President of Halcyon-Foothill Homeowners Association, Inc. , <br /> said he thought it was great that Baker's Square wanted to improve and he <br /> liked the idea of the monument sign. <br /> There being no further comments from the public, on motion of Council Member <br /> Santos, seconded by Council Member Faria and carried unanimously, the Public <br /> Hearing was closed. <br /> On motion of Council Member Perry, seconded by Council Member Faria and <br /> carried unanimously, the City Council granted the Appeal , solely and <br /> exclusively for purposes of deleting Condition II .B. 1 .c. and to modify <br /> Condition II .C. 1 .a. of the Conditions of Approval to provide that the fencing <br /> layout shall be submitted for the review and approval of the Planning and <br /> Building Director for that line which separates the Appellant's property from <br /> the remainder of the premises. <br />
