Implementation of this sales tax is authorized under <br />the Local Transportation Authority and Improvement <br />Act, California Public Utilities Code Section 180000 et <br />seq. In enacting this ordinance, voters will authorize <br />Alameda CTC to have the responsibility to <br />administer the tax proceeds in accordance with all <br />applicable laws and with the Plan. Funds collected <br />for this tax may be spent only for the purposes <br />identified in the Plan, as it may be amended as <br />described in the implementation guidelines. Under <br />no circumstances may the proceeds of this <br />transportation sales tax be applied to any purpose <br />other than for transportation improvements <br />benefitting Alameda County. Under no circumstances <br />may these funds be appropriated by the State of <br />California or any other governmental agency. <br />GOVERNING BODY AND <br />ADMINISTRATION <br />Alameda CTC is governed by a Commission <br />composed of 22 members, with the following <br />representation: <br />• Representatives from each city in <br />Alameda County <br />• All five Alameda County Supervisors <br />• BART <br />• AC Transit <br />The Commission is assisted by staff dedicated to <br />implementation and monitoring of sales tax projects <br />and programs. The total cost assigned for salaries and <br />benefits for administrative employees shall not <br />exceed 1% of the net revenues generated by the sales <br />tax. The total cost of administration of this tax, <br />including all rent, supplies, consulting services and <br />other overhead costs will not exceed 4% of the net <br />proceeds of the sales tax. Repayment of election <br />costs to put the measure on the ballot is included in <br />this Plan. <br />7MING BODY AND <br />ORGANIZATIONAL <br />STRUCTURE <br />INDEPENDENT WATCHDOG <br />COMMITTEE <br />The Independent Watchdog Committee will have the <br />responsibility of reviewing and overseeing all <br />expenditures of sales tax funds by Alameda CTC. <br />The Independent Watchdog Committee reports <br />directly to the public and has the following <br />responsibilities: <br />• The Independent Watchdog Committee must <br />hold public hearings and issue reports, on at least <br />an annual basis, to inform Alameda County <br />residents about how the sales tax funds are being <br />spent. The hearings will be open to the public <br />and must be held in compliance with the Brown <br />Act, California's open meeting law, with <br />information announcing the hearings well- <br />publicized and posted in advance. <br />• The Independent Watchdog Committee will have <br />full access to Alameda CTC's independent <br />auditor and will have the authority to request <br />and review specific information regarding use of <br />the sales tax funds and to comment on the <br />auditor's reports. <br />The Independent Watchdog Committee will <br />publish an independent annual report, including <br />any concerns the committee has about audits it <br />reviews. The report will be published in local <br />newspapers and will be made available to the <br />public in a variety of forums to ensure access to <br />this information. <br />Independent Watchdog Committee members are <br />private citizens who are not elected officials at any <br />level of government, nor public employees from <br />agencies that either oversee or benefit from the <br />proceeds of the sales tax. Membership is limited to <br />individuals who live in Alameda County. Members <br />are required to submit a statement of financial <br />disclosure annually, and membership is restricted to <br />individuals with no economic interest in any of <br />Alameda CTC's projects or programs. <br />
