3.08.050 <br />fication in size, shape or use or it is neces- <br />sary to impose upon such property any of <br />the standards, restrictions and controls of the <br />plan and the owner fails or refuses to agree <br />to participate in redevelopment by executing <br />participation agreement. <br />The agency shall not acquire, without the <br />owner's consent, property to be retained <br />pursuant to a participation agreement, so <br />long as the owner fully performs the agree- <br />ment. (Ord. 99-025 § 206, 1999) <br />3.08.050 Property management. <br />Property owned by the agency shall be <br />under the agency's management and control. <br />The agency may rent or lease such property <br />pending its disposition for redevelopment <br />and may adopt property management poli- <br />cies. (Ord. 99-025 § 207, 1999) <br />3.08.060 Building permits. <br />The agency is authorized to establish <br />building permit application procedures in <br />addition to those generally required by the <br />city. The city shall issue a building permit <br />only after the applicant has obtained the <br />necessary approvals from the agency and <br />has demonstrated compliance with the pro- <br />visions of the plan, any design guide adopt- <br />ed by the agency, any restrictions or controls <br />established by the agency, and any applica- <br />ble agreement. <br />The city shall not issue any building <br />permit in the project area for the construc- <br />tion of any new structure or any addition, <br />construction, moving, conversion or altera- <br />tion to an existing structure, or preparation <br />of any site, or the installation of any physi- <br />cal improvement, including grading and <br />landscaping, until the applicant has com- <br />plied with all pertinent procedures estab- <br />(San Leandro Redevelopment Agency Supp. No. 2, 12-05) 124 <br />lished by the agency. (Ord. 99-025 § 310, <br />1999) <br />3.08.070 Planning commission <br />review. <br />A. If the redevelopment advisory com- <br />mittee or its successor body (if any) so di- <br />rects, the following projects shall be submit- <br />ted to the planning commission for review <br />and recommendation prior to submittal to <br />the redevelopment agency. The commission <br />shall report its findings and recommenda- <br />tions to the agency prior to the agency's <br />consideration of the project. <br />1. Any design guidelines proposals <br />submitted to the agency for adoption; <br />2. Any project that would necessitate a <br />change in land use designation or zoning; <br />3. Streetscape master plans; <br />4. Any land use plans for identifiable <br />multi -parcel areas within the project area, <br />including specific plans or master plans; <br />5. Any plans for new development on <br />sites larger than two acres in the West San <br />Leandro sub -area or larger than one-half <br />acre in the MacArthur Boulevard sub -area; <br />6. Any project for which an environ- <br />ment impact report is required to be pre- <br />pared pursuant to the California Environ- <br />mental Quality Act. <br />B. This section shall not apply to any <br />projects reviewed by the board of zoning <br />adjustments pursuant to the San Leandro <br />zoning code. (Ord. 99-025 § 311, 1999) <br />3.08.080 Actions by the city. <br />A. Upon the agency's request, the city <br />shall aid and cooperate with the agency in <br />implementing the plan and shall take all ac- <br />tions necessary to ensure the continued ful- <br />fillment of the purposes of the plan and to <br />prevent the recurrence or spread in the pro - <br />
