2.08.030 <br />Whether or not a potential participant <br />enters into a participation agreement with <br />the agency, the provisions of this plan are <br />applicable to all public and private property <br />in the project area. (Ord. 93-012 § 407, <br />1993) <br />2.08.030 Certificate of conformance. <br />So as not to require a participation <br />agreement for each property not to be pur- <br />chased, the agency is authorized to make <br />determinations of these properties which <br />conform to this plan. If such determination <br />is made by the agency, the agency may issue <br />a certificate of conformance to qualifying <br />properties and such property will not be sub- <br />ject to acquisition by eminent domain under <br />this plan so long as the property continues to <br />conform to this plan and to such further <br />terms and conditions as the agency may re- <br />quire as necessary or appropriate to carry <br />out this plan. (Ord. 93-012 § 408, 1993) <br />Chapter 2.12 <br />RELOCATION OF PERSONS <br />DISPLACED BY THE PROJECT <br />Sections: <br />2.12.010 <br />Relocation housing <br />requirements. <br />2.12.020 <br />Replacement housing <br />plan. <br />2.12.030 <br />Assistance in finding <br />other locations. <br />2.12.040 <br />Relocation benefits and <br />assistance. <br />(San Leandro Redevelopment Agency Supp. No. 2, 12-05) 70 <br />2.12.010 Relocation housing <br />requirements. <br />No persons or families of low and mod- <br />erate income shall be displaced unless and <br />until there is a suitable housing unit availa- <br />ble and ready for occupancy by such dis- <br />placed person or family at rents comparable <br />to those at the time of their displacement. <br />Such housing units shall be suitable to the <br />needs of such displaced persons or families <br />and must be decent, safe, sanitary and oth- <br />erwise standard dwellings. The agency shall <br />not displace such person or family until such <br />housing units are available and ready for <br />occupancy. <br />Permanent housing facilities shall be <br />made available within three years from the <br />time occupants are displaced. Pending the <br />development of such facilities, there will be <br />available to such displaced occupants ade- <br />quate temporary housing facilities at rents <br />comparable to those in the community at the <br />time of their displacement. (Ord. 93-012 § <br />412, 1993) <br />2.12.020 Replacement housing plan. <br />Not less than thirty (30) days prior to the <br />execution of an agreement for acquisition of <br />real property, or the execution of an agree- <br />ment for the disposition and development of <br />property, or the execution of an owner par- <br />ticipation agreement, which agreement <br />would lead to the destruction or removal of <br />dwelling units from the low and moderate <br />income housing market, the agency shall <br />adopt by resolution a replacement housing <br />plan. <br />Such plan shall include: the general loca- <br />tion of housing to be rehabilitated, devel- <br />oped or constructed pursuant to Section <br />33413 of the Community Redevelopment <br />Law; an adequate means of financing such <br />
