A. The project shall comply with the California Building and Fire Codes as adopted by the <br /> City of San Leandro. Building construction plans shall be submitted and approved prior <br /> to start of any work. <br /> B. At the time of building plan submittal, the ages of the children attending the facility <br /> will need to be clearly stated on the plans. <br /> C. Plans submitted for building permits shall clarify the occupancy classification; <br /> preliminary submittals indicated an occupancy use as Group A3 as a "Pre-School", but <br /> the project is also referred to as a "day care", which is an E occupancy. Said plans shall <br /> also show the required 20 foot wide exit discharge to the public way. <br /> D. The required 20 foot wide fire department access width is to be maintained at all times. <br /> E. A fire alarm system is required for the building housing the day care facility. <br /> VII. MAINTENANCE <br /> A. The site shall be well-maintained and shall be kept free of litter,debris and weeds. <br /> B. Any graffiti on the portion of the property occupied by the applicant shall be removed. <br /> C. All landscaping in the play area shall be maintained in a healthy, growing condition at all <br /> times. <br /> D. All signage shall be kept in a good, clean, sound condition at all times; any damages shall <br /> be promptly repaired. <br /> VIII. GENERAL CONDITIONS <br /> A. A City business license shall be obtained prior to start of business. <br /> B. All requirements of the State of California for child care facilities shall be satisfied and <br /> maintained current and in compliance at all times. <br /> C. The approvals granted by the City as a result of this application, as well as the Conditions <br /> of Approval, shall be recorded in the office of the County Recorder of Alameda County. <br /> D. No application for amendment of the application or Conditions of Approval may be <br /> accepted or submitted for processing by the City unless (i)there is full compliance with all <br /> terms of the application and Conditions of Approval; or (ii) the Community Development <br /> Director waives compliance with minor terms of the application and Conditions of <br /> Approval pending application for amendment. <br /> E. Pursuant to Zoning Code Section 5-2218, this approval shall lapse on July 25, 2014, <br /> unless a) a building permit has been issued, coupled with diligent progress evidencing a <br /> good faith intent to commence the intended use, or b) a written request for a one-year <br /> extension of the use permit is approved by the Community Development Director. <br /> Agreement to Conditions July 25, 2013 <br /> PLN2013-00028 Page 6 of 6 <br />
